Imagining a Possible Future: Self-Represented Litigant Courts (Slaw)
: The growth of self-representation in all adjudicative settings may ultimately require a new approach to adjudication that is even more fundamental than a root and branch overhaul of procedure and practice. What legislators and courts may need to consider is the development of forums that are focused on and limited to adjudicating cases involving SRLs. Such courts would channel cases involving SRLs into a specific forum where court participants, including the adjudicator and court staff and any required wrap-around services, would exclusively plan for and engage with litigants who do not have legal representation. One such experiment has been underway . . . [more] The post Imagining a Possible Future: Self-Represented Litigant Courts appeared first on Slaw
Panorama du parcours doctoral en droit (Sorbonne Student Law Review - Revue juridique des étudiants de la Sorbonne)
: At first glance, the conditions under which a doctoral thesis is written may appear to be secondary to its completion, but the question of the doctoral process is in fact of crucial importance. There are a number of obstacles to overcome: a limited number of thesis supervisors, an uncertain career plan, inherent pitfalls and uncertainty as to whether or not the thesis will be defended. In addition to the difficulty of securing tenure at a later date, these legal and factual factors must be taken into consideration before and during their thesis for all doctoral students in

Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document (FTC USA Business Blog Posts)
: Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document lfair May 23, 2023 | 6:41PM Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document By Lesley Fair Love at first sight may (or may not) be a real thing, but when it comes to investing your money, it’s unwise to fall for a franchise without first subjecting it to tough-minded scrutiny. The third in the FTC’s Franchise Fundamentals blog series walks through an essential part of that evaluation: an in-depth review of the Financial Disclosure Document (FDD) required by the FTC’s Franchise Rule . You must receive the Franchise Disclosure Document at least 14 days before you’re asked to sign any contract or pay any money to the franchisor or one of its affiliates. In fact, you have the right to the FDD once the franchisor has received your application and agrees to consider it. So speak up if you don’t receive it and ask questions – lots of them – as you review the FDD and any attached documents. Image Ind[...]
A stochastic integer programming approach to reserve staff scheduling with preferences (Faculté de droit Travaux récents)
: dc.contributor.author: Perreault‐Lafleur, Carl; Carvalho, Margarida; Desaulniers, Guy dc.date.issued: 2023-04-14 dc.description.abstract: Nowadays, reaching a high level of employee satisfaction in efficient schedules is an important and difficult task faced by companies. We tackle a new variant of the personnel scheduling problem under unknown demand by considering employee satisfaction via endogenous uncertainty depending on the combination of their preferred and received schedules. We address this problem in the context of reserve staff scheduling, an unstudied operational problem from the transit industry. To handle the challenges brought by the two uncertainty sources, regular employee and reserve employee absences, we formulate this problem as a two‐stage stochastic integer program with mixed‐integer recourse. The first‐stage decisions consist in finding the days off of the reserve employees. After the unknown regular employee absences are revealed, the second‐stage decisions are to schedule the reserv[...]
FTC Sends Warning Letters to Companies About Compliance with the TAKE IT DOWN Act (Federal Trade Commission - Protecting America's Consumers)
: The Federal Trade Commission sent warning letters today to a dozen websites advising them of their obligation to comply with the TAKE IT DOWN Act (TIDA), which requires platforms to give people a way to request the removal of intimate photos or videos shared online without their consent, and to remove the intimate photos or videos within 48 hours of a valid request. “Today we’re demonstrating just how serious we are about protecting the public, especially children, from abusive online conduct,” said FTC Chairman Andrew N. Ferguson. “Platforms no longer have any excuses—they must comply with their obligations under the TAKE IT DOWN Act or face the consequences.” The warning letters were sent to 12 companies that offer so-called “nudify” tools that allow people to take a clothed image of an individual and remove the individual’s clothing to create nonconsensual and sexualized images. The letters note that these companies appear to be in violation of TIDA by failing to provide individuals with a process through[...]

Protecting your company from B2B deception By Lesley Fair They may look like invoices sent to business owners for posters they may need to display in the workplace. But we think of them as un voices – deceptively worded solicitations that tried to sell companies posters that are readily available for free. A law enforcement action just settled by the FTC and Florida Attorney General offers tips on protecting your business from this form of B2B deception. According to the FTC and AG, four defendants with ties to Texas and Florida – Starwood Consulting, Starwood Capital, Corporate Poster Supply, and Thomas Henry Fred, Jr. – sent letters to businesses across the country with the goal of tricking them into paying $84 for posters about labor practices. France’s ‘casseurs’: why the term fails to do justice to the extent of looting and spiralling unrest (The Conversation – Articles (FR))
: Following widespread looting sprees and acts of violence occurring on the sidelines of the October 17 student protests, so-called “casseurs” seem to be the centre of attention. But the term, which comes from the French verb casser or “to break”, poses more questions than answers. The sociologist Paolo Stuppia examines the unprecedented situation many cities across France are having to contend with, and the complex combination of collective action whose motivations are unclear and the social media’s extreme agility. The Conversation: How unprecedented are the scenes of looting that we witnessed on the sidelines of the October 17 demonstrations? Paolo Stuppia: What may be unprecedented is the extent of the destruction of private property and the goods that have been stolen. It should be clear, however, that not all the looters can necessarily be sorted into identifiable groups, at least politically. Indeed, as the politician Xavier Crettiez, the sociologist Isabelle Sommier and the historian François Audigier [...]

Now the good news for consumers: It’s still under warranty. But where can they go to get it fixed? Can the manufacturer restrict a consumer’s ability to go to the independent repair shop of their choice? Can the manufacturer use glue, non-standard screws, and proprietary diagnostic software that make it difficult for independent repair shops to fix things? Do limitations like these affect consumers’ rights under the Magnuson-Moss Warranty Act ? That’s the topic of Nixing the Fix: A Workshop on Repair Restrictions , an FTC event scheduled for July 16, 2019 . : Brussels, 18 December - The European Data Protection Board (EDPB) has adopted an opinion* on the use of personal data for the development and deployment of AI models . This opinion looks at 1) when and how AI models can be considered anonymous, 2) whether and how legitimate interest can be used as a legal basis for developing or using AI models, and 3) what happens if an AI model is developed using personal data that was processed unlawfully. Systematically comparing legal systems requires locating sources from different jurisdictions, which are often difficult to access and only available in local languages. The creation of comparative legal datasets has thus involved considerable personnel, time, and financial resources. AI ca[...]

It originally appeared on Slaw.ca on February 15, 2022 . Most legal research is done online through a combination of open and subscription databases. Legal information is available at our fingertips through Justice Laws, LEGISinfo, CanLII, Westlaw, Lexis, ProView, SOQUIJ, [insert your preferred database here], and the list goes on. The availability of electronic resources has radically changed—and will continue to change—the way legal professionals conduct research. However, despite my enthusiasm for the improved accessibility and retrievability, I think the lack of engagement that new legal researchers have with print resources creates comprehension issues. The disconnect between a source’s print and electronic formats reduces their understanding of the process used to create the document. Unders[...]
