The Argument for Encouraging Student Use of AI in First-Year Law (Slaw)
: A consensus is emerging in law schools across Canada and the US that AI has no place in teaching the core curriculum, because it impedes student learning, especially in first year. Schools are beginning to follow the University of Chicago’s lead in banning AI in first-year core courses. Some profs are also banning laptops in classrooms — taking every precaution to shield students’ developing minds from the corrosive effects of AI. Michael Plaxton, one of the leading voices in Canada thinking through the many challenges AI poses to legal education, crystallizes the argument: “The case for law schools must be . . . The Learning Opportunities We Don’t Plan For (Slaw)
: The beginning of another academic year has me reflecting on what more we can give students beyond the curriculum. We spend considerable time thinking about what students need to know and what they need to be able to do. We develop learning outcomes, create assignments, design simulations, evaluate learning, and provide feedback. All those things are important. However, some of the most valuable learning opportunities are not found in the curriculum at all. Sometimes, they arrive in an email. I remember an interaction with a student from several years ago. The student had sent a series of emails that were, . . . [more] The post The Learning Opportunities We Don’t Plan For appeared first on Slaw
The Forgotten History of Prison Law: Judicial Oversight of Detention Facilities in the Nation’s Early Years (Harvard Law Review)
: Prison law is characterized by judicial deference to penal administrators. Despite the well-documented horrors that occur behind prison walls, federal and state courts often decline to intervene, asserting, among other things, that prisoners’ rights are limited and that the judicial branch lacks the power and expertise to get involved in the inner workings of detention facilities. Moreover, jurists often assume that the nation’s first courts largely stayed out of prisons and jails, and contemporary judicial deference is therefore historically rooted. FTC Announces 2027 Telemarketer Fees to Access the National Do Not Call Registry (Federal Trade Commission - Protecting America's Consumers)
: The Federal Trade Commission today announced new fees for telemarketers to access phone numbers on the National Do Not Call (DNC) Registry for Fiscal Year 2027 which begins on October 1, 2026. All telemarketers calling consumers in the United States are required to download the numbers on the National DNC Registry to ensure they do not call consumers who have registered their phone numbers. The first five area codes are free to download, and organizations that are exempt, such as some charities and political callers, may obtain the entire list for free. Telemarketers must subscribe each year for access to the Registry numbers. The cost of accessing a single area code in the registry will be $85 in FY 2027, which is an increase of $3 from FY 2026. The maximum charge to any single entity for accessing all area codes nationwide will be $23,425 (up from $22,626 in FY 2026). The fee for accessing an additional area code for a half year will increase to $43 in FY 2027 from $41 in FY 2026. The Commission vote autho[...]

The Wellness Lawyer: “Kindness” (Slaw)
: I recently watched a movie, and one of the characters, who was bullied, made a very poignant statement. She said: “If the person who bullied me decided not to be mean, his life would not have changed... however, my life would have been profoundly different.” It struck me, that those who are unkind, would not lose anything by being kind. In fact, many benefits are derived from showing kindness to others. However, as we all know, the person who is on the receiving end of the bullying or unkindness, is affected in ways that reverberate for years, and at times, . . . Managing Client Expectations (Slaw)
: In almost every context, first impressions are key. I would argue that, for lawyers, communicating clear expectations during that first meeting is an essential skill. It is not a skill that comes easily. I have spoken about this topic with many lawyers over the years. There seems to be a clear divide between newly-called lawyers who have a tendency to make grand promises and seasoned lawyers who temper expectations. There is no “right” or “wrong” approach here. Everyone has to figure out their own style. My own style has been to keep expectations low…. very low. I conduct on average . . . [more] The post Managing Client Expectations appeared first on Slaw
Reconsidering Common Objections to Mediation (Slaw)
: Most of the common reasons for declining mediation are well known. These include concerns that it may be premature, that additional information is required, or that the opposing party is unreasonable. Other justifications include the belief that the law is clear, the case is strong, and mediation would only increase costs. Some of these concerns are legitimate. Not every dispute is suitable for mediation, and even appropriate cases may not be ready for mediation at a particular stage. Ontario has now had mandatory mediation in parts of the province for more than twenty-five years. The program began in Toronto and . . . Where Are the Law Librarians? (Slaw)
: In recent years, the number of law librarians in public sector and academic roles has declined. Most notably, the Ontario Ministry of the Attorney General (MAG) has reduced the staff of its Toronto-based law library to the point that, as of sometime in 2025, it no longer has a professionally staffed law library. [2] In other words, no actual librarians work at the law library of the Ministry of the Attorney General. Beyond Day One: The Onboarding System Firms Still Haven’t Built (Slaw)
: Your mid-sized firm invested $500,000 recruiting four to five new students last year. By year five, 91 percent are gone. Your per-person investment was roughly $100,000 to $125,000. Add salary, training, and mentorship. Then they leave. The question worth asking is whether you hired the wrong people, or whether you didn’t integrate them. The data suggests the latter. When the National Association for Law Placement Foundation surveyed departing Canadian associates, 29 percent cited work quality concerns. Sixteen percent pointed to productivity standards they felt they weren’t meeting. Thirteen percent said the advancement path was unclear. Thirteen percent mentioned fit. Another . . . Update from the Private Law Library Special Interest Group (SIG) (Canadian Association of Law Libraries / L'Association canadienne des bibliothèques de droit CALL/ACBD Blog)
: Hello. The CALL Private Law Library Special Interest Group met October 2 for the first meeting of the 2024-2025 session. This year we are going to focus on soft skills in private law libraries, and we started with reviewing statistics and data-driven decision making. These decisions can be as simple as which books to weed based on circulation statistics to as in-depth as which products to cancel based on little use. We welcomed a number of private law librarians for a rousing discussion on the use of stats, how we make decisions, how we report the statistics to our managing partner / C-level team / lawyers, and everything in between. We ended with a round table, as we often do, and came up with some ideas for future sessions, including how private firms bill / don’t bill for online research, how to use the stats to inform new training sessions, and will AI ever be able to run stats for us? We concluded with a call for private law librarians to volunteer with CALL’s mentorship program, which is making a com[...]
The Hidden Economics of the Vanishing Apprenticeship (Slaw)
: Two columns ago, I followed the money through a law firm’s student recruitment program and found nearly $500,000 a year in lawyer time and expenses before a single billable hour was worked. Last column, I followed that same money into the delegation of actual work and found that firms were quietly losing much of it back through vague instructions, overworked memos, and write-downs nobody quite wants to talk about. This column follows that same money to where it gets spent – on the reps junior lawyers used to log before anyone trusted them with something that mattered. Those reps are . . . I have been writing and talking about this issue for many years, most recently as part of my ‘The Law Firm’ series: Pyramid Rollover , Private Equity Puzzle , Disappearing Act , Foundational Rebuild , and now this one, Inflection Point. FTC Finalizes Order Settling Allegations that GM and OnStar Collected and Sold Geolocation Data Without Consumers’ Informed Consent (Federal Trade Commission - Protecting America's Consumers)
: The Federal Trade Commission finalized an order with General Motors and OnStar settling allegations that they collected, used, and sold consumers’ precise geolocation data and driving behavior data from millions of vehicles without adequately notifying consumers and obtaining their affirmative consent. Under the order finalized by the Commission, General Motors LLC, General Motors Holdings LLC, and OnStar, LLC (collectively GM), which are owned by General Motors Company, are prohibited from sharing certain consumer data with consumer reporting agencies. They also are required to take steps to provide greater transparency and choice to consumers over the collection, use, and disclosure of their connected vehicle data. In a complaint first announced in January 2025, the FTC alleged that GM used a misleading enrollment process to get consumers to sign up for its OnStar connected vehicle service and OnStar Smart Driver feature. The FTC also alleged that GM failed to clearly disclose that it collected consumers’ [...]

Tackling run-down housing and climate change through the restoration of vernacular architecture? Insights on public action in Marseille's historic housing stock (ESPI2R)
: Context In the face of climate change and with its Mediterranean climate, the city of Marseille and its densely built historic center are likely to be increasingly confronted with risks such as heat waves, drought, and heavy rainfall in the coming years (Gaucher et al., 2020). Marseille’s historic housing stock also faces severe deterioration, especially in working-class areas of the first three districts. These issues have been highlighted since 2018 and the collapse of two buildings in the Noailles district, which caused the deaths of eight residents. The wave of mass evacuations that followed, affecting over 1,200 buildings and between 7,000 and 11,000 people over the following six-year period (Dorier, 2024), and the strong citizen reaction to these events have put run-down housing back on the public agenda in the historic city centre. Today Marseille’s city centre is the focus of an urban redevelopment project (projet partenarial d’aménagement) voted in 2019, which directly resulted from the 2018 buildin[...]

EDPB and AMLA to develop Joint Guidelines on partnerships for information sharing (EDPB News)
: Brussels/Frankfurt, 1 July – The EDPB and the Anti-Money Laundering Authority (AMLA) are working together to bring greater clarity to a question of growing importance for industry and authorities alike: how to share information to fight financial crime while protecting personal data. Why information sharing matters The fight against financial crime depends on cooperation, and information sharing can help detect and prevent money laundering and terrorist financing. Art. 75 of the AML Regulation makes this possible, allowing companies and professionals covered by anti-money laundering rules to share information with each other and with public authorities, within clear limits. The new information sharing possibility will apply from 10 July 2027. To provide clarity on this possibility, the EDPB and AMLA will work together on the development of Joint Guidelines. Clearer rules for industry and authorities Sharing information of this kind means processing personal data, which is why data protection safeguards are[...]
FTC Releases Annual Do Not Call Registry Data Book (Federal Trade Commission - Protecting America's Consumers)
: The Federal Trade Commission today released the National Do Not Call Registry Data Book for Fiscal Year 2025 , which shows that, while overall complaints rose in FY 2025, unwanted calls remain about 48% lower than in FY 2021, when the FTC received approximately five million reports about unwanted calls. The FTC’s annual data book provides detailed information on robocall and live-caller complaints, the topics consumers report most often, and a state-by-state breakdown of registrations and complaints per 100,000 people. As in prior years, calls about reducing debt, imposters, and medical and prescription issues remained among the topics consumers most frequently reported in FY 2025. The National Do Not Call (DNC) Registry lets consumers add their phone numbers and opt out of most legal telemarketing calls. In FY 2025, more than 4.7 million additional phone numbers were added to the Registry, bringing the total to about 258.5 million active registrations as of September 30, 2025—an increase of roughly 1.9% ove[...]
CEF 2026: EDPB launches coordinated enforcement action on transparency and information obligations under the GDPR (EDPB News)
: Brussels, 19 March - The EDPB has launched its Coordinated Enforcement Framework (CEF) action for 2026*. Following a year-long coordinated action on the right to erasure in 2025 , the CEF's focus this year will shift to compliance with the obligations of transparency and information under the GDPR . The GDPR ensures that individuals are informed when their data is being processed (under Art. 12, 13 and 14). This right to be informed is a core element of transparency and ensures that individuals have more control over their data. Next steps During 2026, 25 Data Protection Authorities (DPAs) across Europe will take part in this initiative. They will look closely to assess the compliance of controllers with their transparency obligations under the GDPR. Participating DPAs will soon contact controllers from different sectors across Europe, either through enforcement actions or fact-finding exercises. In the latter case, they might also decide to undertake additional follow-up actions if needed. During the second[...]
The Old Québec (Vieux-Québec) historic district: Heritage, tourism and real-estate developers since the post-war years (ESPI2R)
: Introduction There are several ways of conceiving heritage conservation. For the purpose of this paper, we need to start from the premise that what we call “heritage” is a dynamic, evolving reality, and that a historic district such as “Old Québec” can undergo structuring transformations rooted in a process of heritage conservation. In Old Québec, the process of conservation —also referred to “patrimonialization”—has not received the attention it deserves. This paper aims to shed light on the process of functional requalification has undergone by Old Québec since the 1950s, within the broader context of its transformation into a historic district. It is based on discourse analysis (Berthold, 2013), supported by a diversifie body of documentation, including primary sources, such as archival documents, press reviews, geospatial and land-use data, and official reports. It is complemented by a body of scholarly literature devoted to Old Québec since the 1970s. First, we explain the sociohistorical process that l[...]
France: three overlapping woes are fuelling a generation of discontent (The Conversation – Articles (FR))
: KEY TAKEAWAYS The French high schooler-led uprising is not a sign of a generational struggle pitting the young against baby boomers. The uprisings indicate a state of discontentment reflecting three grievances: failings within the education system, eco-anxiety and concerns over employment in the age of AI. Far from demanding a break with the established order, young protesters are simply asking for the right to live a good and fair life... like their predecessors before them. Rarely has Freud’s Civilization and Its Discontents seemed so relevant to the times in which we are living. Although the discontents we are currently witnessing do not necessarily affect society as a whole, they are certainly impacting an entire generation born in the 21st century, as well as their parents and their social environment. Admittedly, we know that generations are not homogeneous and that any attempt to generalise is an oversimplification. Nevertheless, the high schoolers that are taking to the streets to protest in this day[...]

The (Currently) Uneven Intelligence of AI in Comparative Constitutional Law (Scoop.it - Documentation juridique (Stéphan Cottin))
: This article belongs to the debate » Thinking Machines, Thinking Lawyers14 October 2026The (Currently) Uneven Intelligence of AI in Comparative Constitutional Law From Years of Research to a Single Prompt? Artificial intelligence (AI) has the potential to accelerate and improve the quality of research. This potential has inspired numerous projects exploring how AI could help scholarship on constitutional law. For example, there is research using AI to interpret constitutions,1) apply constitutional principles,2) and predict court rulings.3) Even the question of whether AI could improve the process of constitution-making has been studied.4) AI’s potential is particularly significant for comparative constitutional research. Systematically comparing legal systems requires locating sources from different jurisdictions, which are often difficult to access and only available in local languages. The creation of comparative legal datasets has thus involved considerable personnel, time, and financial resources. AI ca[...]
FTC Seeks Public Comment on Whether to Update Rule on Impersonation of Government and Businesses to Address Platforms’ Role in Promoting Impersonation Scams (Federal Trade Commission - Protecting America's Consumers)
: The Federal Trade Commission announced today that is considering whether to update its Rule on Impersonation of Government and Businesses or take other action to prevent online platforms from engaging in ad-optimization practices that may be furthering impersonation scams. In an Advance Notice of Proposed Rulemaking (ANPRM) to be published in the Federal Register , the FTC is seeking comment on the extent to which ad-optimization tools and services offered by social media, search engines and other digital marketplace platforms further efforts by scammers to impersonate legitimate businesses and government agencies using online ads. “Free markets depend on trust, transparency and consumers’ ability to make informed choices. Impersonation scams—especially when amplified by digital platforms that profit from them—do more than rob Americans of their hard-earned money,” said Christopher Mufarrige, Director of the FTC’s Bureau of Consumer Protection. “They erode the very foundation that allows competitive markets[...]
Florida Officials Urge Federal Judge to Dismiss Constitutional Challenge to Cultivated-Meat Ban (The Daily Intake)
: Officials in Florida are urging a federal judge to dismiss UPSIDE Food's (UPSIDE) constitutional challenge to the state's cultivated meat ban, SB 1084 , arguing that the company's claim is vague and unsubstantiated. UPSIDE claims that the ban was enacted for discriminatory purposes in violation of the Dormant Commer Clause. The company's complaint cites to public comments made by Florida Governor Ron DeSantis and Florida Ag Commissioner Wilton Simpson that claimed the out-of-state cultivated meat industry threatens Florida's in-state conventional meat and agricultural industries. UPSIDE argues that these comments demonstrate Florida's sole intent in enacting the ban was to protect the state's cattle industry. While the court previously denied UPSIDE's motion for a preliminary injunction and rejected its claim that the Poultry Products Inspection Act preempted the law, as we reported last year , it allowed the company to proceed with its constitutional challenges to the law. Florida's SB 1084, the nation's fi[...]

Changes in world trade routes: an opportunity for secondary ports? (Les Cahiers Scientifiques du Transport - Scientific Papers in Transportation - Dernières publications)
: Over the last thirty years, the increasing globalisation of economic exchanges has contributed to the emergence of a network of main ports linked together by maritime transport and, in particular, the lines developed by the major shipping lines or the alliances they have formed. In addition to Asian ports, and particularly Chinese ports given the national port strategy, this network of main ports has also been structured by investments made by shipping lines in port terminals intended to become their regional hubs and thus facilitate the massification of flows. From these hubs, feeders serve other ports, giving rise to a form of classification within these main global ports. This organisation has helped to shape the global value chains, or world trade routes, which are both the medium and the result of globalisation. : The Federal Trade Commission sent warning letters today to a dozen websites advising them of their obligation to comply with the TAKE IT DOWN Act (TIDA), which requires platforms to give people a way to request the removal of intimate photos or videos shared online without their consent, and to remove the intimate photos or videos within 48 hours of a valid request. “Today we’re demonstrating just how serious we are about protecting the public, especially children, from abusive online conduct,” said FTC Chairman Andrew N. Ferguson. “Platforms no longer have any excuses—they must comply with their obligations under the TAKE IT DOWN Act or face the consequences.” The warning letters were sent to 12 companies that offer so-called “nudify” tools that allow people to take a clothed image of an individual and remove the individual’s clothing to create nonconsensual and sexualized images. The letters note that these companies appear to be in violation of TIDA by failing to provide individuals with a process through[...]

FTC, States Sue Amazon Over Secret Ad Surcharge Scheme (Federal Trade Commission - Protecting America's Consumers)
: Today, 22 states joined the Federal Trade Commission in filing suit against Amazon, alleging that the company engaged in deceptive and unfair practices that secretly inflated prices in its online search advertising auctions. The complaint alleges that, for over seven years, Amazon has covertly and substantially increased the prices that more than one million brands and sellers were required to pay to advertise on its platform. As a result, the complaint alleges that Amazon’s scheme has likely extracted tens of billions of dollars from its unwitting advertising customers. “When one of the world’s largest online retailers engages in unfair and deceptive conduct, the impact can be staggering,” said Chairman Andrew N. Ferguson. “Amazon has millions of advertising customers who were misled into paying significantly higher prices. These higher costs were largely passed on to American consumers. The FTC under President Trump won’t allow this deception to continue.” The FTC, along with the attorneys general of Ala[...]

: Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document lfair May 23, 2023 | 6:41PM Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document By Lesley Fair Love at first sight may (or may not) be a real thing, but when it comes to investing your money, it’s unwise to fall for a franchise without first subjecting it to tough-minded scrutiny. The third in the FTC’s Franchise Fundamentals blog series walks through an essential part of that evaluation: an in-depth review of the Financial Disclosure Document (FDD) required by the FTC’s Franchise Rule . You must receive the Franchise Disclosure Document at least 14 days before you’re asked to sign any contract or pay any money to the franchisor or one of its affiliates. In fact, you have the right to the FDD once the franchisor has received your application and agrees to consider it. So speak up if you don’t receive it and ask questions – lots of them – as you review the FDD and any attached documents. Image Ind[...]
Governor Newsom Signs Bill for Non-UPF Certification Program (The Daily Intake)
: Governor Newsom has signed California's AB 2244 , which creates the country's first voluntary non-ultraprocessed food certification program. By June 1, 2029, the California Department of Public Health (CDPH) must develop a system to accredit independent certification agents that can certify food products as “Non-Ultraprocessed Certified.” The “Non-Ultraprocessed Certified” seal (proposed previously to be “California Certified”) may only be used for foods that do not qualify as an ultraprocessed food (UPF), UPF of concern, or a restricted food, as defined by California's UPF standards introduced in 2025. The program will allow certified products to display the seal on their packaging and will require manufacturers to recertify their products every three years. CDPH must create and maintain a public database of these certified products. Under the law, retailers with more than 25 individual non-UPF-certified product types and who generate more than $10 million in sales annually will be required to prominently d[...]

In 1918, the Commission opened the first three of its regional offices. Today, eight regional offices continue to knock it out the park on behalf of America’s consumers. So it’s only fitting that on this momentous day we acknowledge the regional offices’ century of pennant-winning performances. According to the Commission’s 1918 Annual Report, “In order to expedite the greatly increased work of the Commission . . . small branch offices were established in New York, Chicago, and San Francisco.” Over time, the FTC has added other locations for a current total of eight offices in seven regions. Regional staff work with the Bureau of Consumer Protection and the Bureau of Competition on investigations and litigation. But they are in [...]

That’s the allegation in a complaint filed by the FTC and the Minnesota Attorney General . In addition, it’s the FTC’s first case charg ing violations of the Consumer Review Fairness Act. The roots of the allegations go back to another venture sued by the FTC earlier this year: FBA Stores, also known as Amazing Wealth System and Amazon Wealth Systems. The defendants in that case ran online ads and in-person workshops that claimed to reveal the secret s of making major money on Amazon. But few, if any, of the consumers who forked over thousands of dollars and implemented their “plug-and-play systems” earn ed the kind of c[...]

Made in USA? Avoiding a Yankee Doodle Don't (FTC USA Business Blog Posts)
: Made in USA? Avoiding a Yankee Doodle Don't wfg-adm109 October 21, 2013 | 11:17AM Made in USA? Avoiding a Yankee Doodle Don't By Lesley Fair There are lots of nifty phone accessories, bottle holders, tow straps, pet items, and lanyards out there. So a label that says the product is Made in the USA may help make the decision for some consumers. When it bears the American flag and says “TRULY MADE IN THE USA,” that just might seal the deal. But according to an FTC lawsuit , a lot of the “Made in the USA” merchandise touted by Logan, Utah-based E.K. Ekcessories wasn’t really made in the USA – turning the company’s claims from a Yankee Doodle Do to a Yankee Doodle Don't. E.K. Ekcessories sells a variety of outdoor equipment through popular retailers and on its own site. In addition to the labels, the company touted its products’ U.S. pedigree with statements like “For 28 years E.K. Ekcessories has been producing superior quality made accessories in our 60,000 sq. ft. facility in Logan, Utah,” and “Our source[...]

At The Disco’s High Hopes , but according to a new FTC Data Spotlight , all too often it ends with the conclusion that – to quote the J. Geils Band – Love Stinks . Far be it from us to put a damper on Valentine’s Day, but reports to the Consumer Sentinel Network suggest that the injury inflicted by romance scams is on the rise. According to the new Data Spotlight , “For three years running, people have reported losing more money on romance scams than on any other fraud type identified in Sentinel. In 2020, reported losses to romance scams reached a record $304 million, up about 50% from 2019. For an individual, that meant a median dollar loss of $2,500.” Why the increase? The continued popularity of dating apps is part of the story, but the pandemic has played a part, too. For right now, the need for social distancing and masking makes the “meet cute” at the local cof[...]
FTC Data Show People Reported Losing $3.5 Billion to Imposter Scams in 2025 (Federal Trade Commission - Protecting America's Consumers)
: New data from the Federal Trade Commission reveal that people reported losing a staggering $3.5 billion to imposter scams in 2025, with reported losses increasing nearly three times since 2020. FTC data also show that people reported imposter scams more than any other fraud category in 2025—nearly one in three fraud reports were about imposter scams. These scams lured consumers through text, phone, email, social media, search engine results and other means. Some of the costliest impersonation scams start with a fake security alert, often from a bank. People are convinced to move money to “protect” it, with their losses often limited only by their available funds. Last year, people reported losing nearly $1 billion to business impersonators with the highest reported losses to bank impersonators—and about $920 million to government impersonators, up from $866 million and $789 million respectively in 2024. The FTC has seen a striking increase in reported fraud losses to all types of fraud—about $16 billion was [...]

The impossible equation of being a researcher mother, striving to make ends meet (The Conversation – Articles (FR))
: How can we encourage women to pursue scientific careers? In recent years, a number of mentoring or awareness campaigns have been put in place to encourage French high school students to study maths, physics or engineering sciences, while they remain underrepresented in these fields. One of the last large-scale initiatives is the Filles et Maths program , launched in 2025, including work on gender bias, the implementation of “role models” or timetables featuring flexible hours. The program was nonetheless met with criticism: while women remain under-represented in some disciplines, they also remain a minority in the highest positions across the board in the academic world, from mathematics to social sciences. In France, gender inequalities are therefore not limited to access to scientific studies: they cut across all university careers and make many women leave French Higher Education and Research before securing tenure. This “drain” is explained by several factors among which motherhood holds an important pl[...]
7-Eleven to Pay Record $4.5 Million Penalty to Settle FTC Antitrust Order Violation Case (Federal Trade Commission Concurrence communiqués)
: 7-Eleven, Inc. and its parent company, Seven & i Holdings Co., Ltd., (collectively 7-Eleven) will pay $4.5 million to settle a Federal Trade Commission lawsuit alleging that the convenience store chain violated a 2018 FTC consent order by acquiring a fuel outlet in St. Petersburg, Fla. without providing the Commission prior notice. The $4.5 million penalty marks the largest civil penalty ever collected in an FTC case involving a prior-notice violation. It is also the largest negotiated settlement of any order violation in the FTC Bureau of Competition’s history. “Under the Trump-Vance FTC, merger remedies that protect competition are once again on the table. But for merger remedies to work, firms must abide by the terms of their consent orders, and we will hold parties accountable when they don’t live up to their commitments,” said Daniel Guarnera, Director of the FTC’s Bureau of Competition. “7-Eleven failed to fulfill the terms of the FTC’s consent order and is now paying a record price. But that’s not the only way the Spokeo settlement touches on social media. The FTC also charged that Spokeo violated Section 5 by having employees post glowing recommendations of the company’s services on news and technology websites without disclosing their true identity. Perhaps just the work of a rogue cubicle occupant? No, said the FTC. According to the complaint , Spokeo directed its employees to write the comments. Spokeo managers then edited what they wrote and had the staffers post the endorsements using account names provided by Spokeo. The purpose, says the FTC, was to give read[...]
