[{"source":"BEREC Office","description":"BEREC Study trip to Japan yannick.stephan Tue, 03/11/2026 - 10:27 Latest News From 26 to 30 October, BEREC’s leadership visited Japan on a study trip aimed at strengthening international relations and exchanging experience with key partners from government, industry, research and academia. The delegation was led by BEREC Chair Marko Mismas (AKOS, Slovenia) and was made up of Vice-Chairs Alejandra de Ituarriaga (CNMC, Spain), Michel Van Bellinghen (BIPT, Belgium), Sarah Jacquier-Pelissier (Arcep, France), Giacomo Lasorella (AGCOM, Italy), Klaus Steinmaurer (RTR, Austria) and Robert Mourik (ComReg, Ireland). The representative of participants without voting rights, Milan Radulovic (EKIP, Montenegro), and the Director of the BEREC Office, Verena Weber, also joined the delegation. The visit was part of BEREC’s broader efforts to deepen dialogue with international stakeholders and to gather first-hand insight into developments in advanced digital and telecommunications markets. Japan, as a global leader in connectivity, technology and research, offered an ideal setting for discussions on the future of electronic communications and digital policy. Exchanges with public institutions During the visit, BEREC’s delegation met with representatives of the European Union Delegation to Japan and the Ministry of Internal Affairs and Communications. Conversations focused on the broader policy and regulatory landscape, shared priorities in connectivity, digital transformation and emerging technologies, and EU–Japan trade links, with a particular emphasis on digital matters. Discussions with the Ministry of Internal Affairs and Communications covered developments in fixed broadband, including fibre deployment, digital infrastructure development and international submarine cables, as well as trends in Japan’s mobile communications policy, notably in relation to 5G and 6G. Developments in non-terrestrial networks, Japan’s policy approach to network resilience and AI governance, including the Hiroshima AI Process and the activities of the Friends Group, were also addressed. Dialogue with industry BEREC’s leadership also met with Sony, SoftBank, NTT, Rakuten and Ericsson. Discussions with industry provided an opportunity to exchange views on market developments, innovation in telecommunications and digital services, investment in network infrastructure, future network technologies, cloud-native solutions, Open RAN, and security and sustainability. At NTT, the company’s vision for the Innovative Optical and Wireless Network (IOWN) was also touched on, with developments in next-generation communications infrastructure and future network architecture highlighted. In addition to the meetings organised, the delegation visited a dedicated briefing facility at SoftBank’s headquarters, where guests were presented with advanced technologies and solutions developed by SoftBank and its partners. The visit included live demonstrations and interactive presentations, covering areas such as high-altitude platform stations (HAPS), non-terrestrial networks, artificial intelligence, 5G and digital transformation. Perspectives from academia and research The BEREC leadership also met with representatives from the University of Tokyo and the RIKEN Centre for Computational Science. These visits offered academic and research perspectives on emerging technologies, artificial intelligence, high-performance computing, data-driven innovation and the future development of digital ecosystems. The study trip underlined the importance of continued international engagement for BEREC, particularly amid rapid technological change and growing global interdependence in the electronic communications sector. The visit also reaffirmed BEREC’s commitment to exchanging knowledge and best practices with public authorities, market players and research institutions worldwide. <div","id":3260964,"url":"https://www.berec.europa.eu/en/news/latest-news/berec-study-trip-to-japan","titre":"BEREC Study trip to Japan","pubDate":"Tue, 03 Nov 2026 14:32:41 +0100"},{"description":"KEY TAKEAWAYS The French high schooler-led uprising is not a sign of a generational struggle pitting the young against baby boomers. The uprisings indicate a state of discontentment reflecting three grievances: failings within the education system, eco-anxiety and concerns over employment in the age of AI. Far from demanding a break with the established order, young protesters are simply asking for the right to live a good and fair life... like their predecessors before them. Rarely has Freud’s Civilization and Its Discontents seemed so relevant to the times in which we are living. Although the discontents we are currently witnessing do not necessarily affect society as a whole, they are certainly impacting an entire generation born in the 21st century, as well as their parents and their social environment. Admittedly, we know that generations are not homogeneous and that any attempt to generalise is an oversimplification. Nevertheless, the high schoolers that are taking to the streets to protest in this day and age belong to a relatively homogeneous age cohort. You would be forgiven for thinking that the current unrest is the result of a clash of generations. From the outside, it is often viewed as a generational tug of war between a struggling young population and the rest: an aging but relatively prosperous Europe . Criticism is, without doubt, being directed at “baby-boomers” or those born during the thirty years following World War II (which were marked by economic prosperity and low unemployment, conditions that now seem a world away today). The problem lies elsewhere Nevertheless, this is not a generational conflict, and the fact that a substantial proportion of parents , as well as the majority of the population , share the students’ demands shows that the problem lies elsewhere. These demands are nothing new, and they help explain why many parents joined their children during the first demonstrations, along with teachers, to show their support over deteriorating conditions in high schools. The students and their initial demands were hijacked by more politically radical movements, some even revolutionary or anarchist, as well as opportunistic groups that took advantage of the disorder to loot shops and businesses, without any tangible political agenda. According to an official report dated October 14, 2026, “937 law enforcement officers, 248 students and 149 members of educational staff have been injured since the beginning of the high school student movement.” The demonstrations on October 18 resulted in more than 1,800 arrests . The proliferation of various groups with overlapping demands muddles the student movements’ original message, leaving us with little more than the smouldering remnants of a battlefield. Nevertheless, it is the central concerns of these students that I wish to explore here. Ultimately, this movement appears to lie at the intersection of several anxiety-inducing issues. Rather than speaking of a convergence of struggles, we should speak of a convergence of anxieties. Three sources of anxiety The movement appears to reflect the convergence of three factors that are also sources of concern: the perceived deterioration of public education ecological anxiety the new difficulties young people face in the labour market, particularly those associated with the development of artificial intelligence (AI). These three factors provide fertile ground for psychosocial anxiety. The high school students’ main demands appear legitimate and concern improving working conditions: replacing absent teachers, shortening excessively long school days, reducing the number of students per class, repairing and maintaining infrastructure, and improving or abolishing Parcoursup , the widely criticised higher education admissions platform that is often difficult to understand. These demands echo the broader perception that conditions in the French school system have deteriorated and that the system is relatively inefficient compared with those of neighbouring countries.","id":3248553,"source":"The Conversation – Articles (FR)","titre":"France: three overlapping woes are fuelling a generation of discontent","url":"https://theconversation.com/france-three-overlapping-woes-are-fuelling-a-generation-of-discontent-295102","pubDate":"Thu, 29 Oct 2026 07:58:22 +0100"},{"description":"KEY TAKEAWAYS Social policies, such as support for small businesses, and a shorter working week without a loss of pay helped president Lula to turn around Brazil’s election. Street protests and social media strengthened Lula’s campaign amid allegations of election interference by Meta favouring Flávio Bolsonaro. Major challenges lie ahead as Lula faces a right-leaning Congress, opposition from the Bolsonaro movement and pressure from the Trump administration. Luiz Inácio Lula da Silva won Brazil’s presidential election with 51.79% of valid votes, unexpectedly reversing the first-round result won by Flávio Bolsonaro, a first in Brazilian presidential elections. Between the two rounds, he gained about 10.4 million additional votes. Defeated, right-wing challenger Flávio Bolsonaro announced that he would ask for the election to be annulled. The next day, his party, the Liberal Party (PL), acknowledged the result. Brazil’s nonalignment sounds a warning to the global far right Beyond halting the advance of Donald Trump’s and Secretary of State Marco Rubio’s influence in the region, Brazil’s election result points to strategies by which far right success in other countries can be contained. It is also a personal defeat for Trump, who invested energy and influence without openly declaring his support, but with the objective of returning the Bolsonaro family to power. Lula’s victory can be attributed to three equally important factors. The first is a package of social measures: an increase in Bolsa Família, the government’s flagship cash-transfer program; the announcement of measures benefiting individual microentrepreneurs (MEI), who account for nearly 70% of active businesses in Brazil; and, above all, the approval, during the second-round campaign, of the government’s bill reducing the working week from six to five days with no loss of pay . In a poll conducted four days before the vote, this legislation was the news item that mattered most in determining voters’ choice (17%). It was followed by reports of Supreme Federal Court (STF) justices’ involvement in the Banco Master corruption case (14%), politicians’ involvement in the same case (13%), and the Lula government’s lifting of the ban on online betting houses, known as “bets” (11%). Between the two rounds, Lula raised his government’s approval rating, particularly among higher-income voters (+6 p.p) and right-wing voters outside of bolsonarismo (+12 p.p), i.e. groups that make up Flávio’s voter base. Over the same period, fear of the Bolsonaro family’s return to power overtook fear of Lula’s reelection (44% to 42%) . Taking to the streets and digital power Such a turnaround was driven, in large part, by mass mobilisation of Lula’s supporters in the streets and on social media. Large rallies called by students and other mostly young people brought millions of people on the streets, breaking the chill seen in the preceding weeks . The largest rally in support of Lula took place in São Paulo on October 24. Demonstrators sang the Independence Anthem of Brazil, a clear reference to Brazil’s independence from Trump’s interventionist policy . Part of this interventionism was attributed to the actions of Meta, the parent company of Instagram, Facebook and WhatsApp. During the second-round campaign, allegations grew that the company had favoured Flávio Bolsonaro and other far-right candidates by manipulating its algorithms . While Meta denied any favouritism, blaming technical failures, internal messages revealed by Folha de S. Paulo revealed that Lula’s campaign had been unable to boost posts for nearly 24 hours in October. Far from corresponding to their modern meanings, these two notions are not radically opposed, but are rather complementary within Platonic philosophical activity, the latter understood as a complex path in the search for truth and wisdom. The first chapter deals with the historical evolution of the uses of the terms mythos and logos, based on examples from the archaic and classical periods. The second chapter analyzes the practical dimension of Greek myth, insofar as it is closely linked to rituals and has sociopolitical implications. The third chapter presents the complexity and polysemy of the concept of myth in Plato, while highlighting the important role that this type of discourse holds in his works. And it’s at the center of a law enforcement action against department store chain Lord & Taylor for its allegedly deceptive use of native advertising – the first case of its kind since the FTC released its Enforcement Policy Statement in December. The lawsuit also challenges Lord & Taylor’s “product bomb” campaign on Instagram as misleading. Lord & Taylor used an extensive social media push to launch Design Lab, its own apparel line aimed at women between 18 and 35. The strategy was interesting: Focus on just one item – that paisley asymmetrical dress. For the native advertising part of the campaign, Lord & Taylor signed a contract to have Nylon, an online fashion magazine, run an article about the Design Lab collection featuring a photo of the paisley dress. Lord & Taylor reviewed and approved the paid-for Nylon article, but didn’t require a disclosure about their commercial arrangement.  In addition, Lord & Taylor contracted to have Nylon post a photo of the paisley dress on Nylon’s Instagram page. Again, Lord & Taylor reviewed and approved the paid-for post, but didn’t require a disclosure. That was only part of the campaign. Lord & Taylor also recruited a team of fashion influencers, all of whom had two things in common: a sense of style and a massive number of followers on social media platforms. Lord & Taylor gave the dress to 50 influencers and paid them between $1,000 and $4,000 to post photos of themselves in the dress on Instagram on one specified “product bomb” weekend in March 2015 – the same weekend when Nylon posted its Lord & Taylor-approved photo. Style the dress any way you like, Lord & Taylor told the influencers, but in other aspects, the contract was all business. The influencers had to: 1) use the @lordandtaylor Instagram user designation and the campaign hashtag #DesignLab in the photo caption; and 2) tag the photo @lordandtaylor. Lord & Taylor’s reps preapproved each of the influencers’ Instagram posts to make sure they included the required hashtag and Instagram designation. The company also edited some of what the influencers planned to say. But despite the company’s punctilious approach to hashtags, handles, and the like, Lord & Taylor was curiously silent about other key aspects of the campaign. For example, according to the FTC, Lord & Taylor’s contract didn’t require the influencers to disclose that Lord & Taylor had paid them. Furthermore, none of the Instagram posts Lord & Taylor approved included a disclosure that the influencer had received the dress for free, that she had been compensated for the post, or that the post was a part of a Lord & Taylor ad campaign. And as the complaint alleges, Lord & Taylor didn’t add a disclosure to that effect to any of the influencers’ posts it reviewed. The Instagram campaign reached 11.4 million individual users, resulting in 328,000 brand engagements – likes, comments, reposts, etc. – with Lord & Taylor’s Instagram handle.  And the paisley dress sold out. The FTC complaint charges Lord & Taylor with three separate violations:  1) that Lord & Taylor falsely represented that the 50 Instagram images and captions reflected the independent statements of impartial fashion influencers, when they really were part of a Lord & Taylor ad campaign to promote sales of its new line; 2) that Lord & Taylor failed to disclose that the influencers were the company’s paid endorsers – a connection that would have been material to consumers; and 3) that Lord & Taylor falsely represented that the Nylon article and Instagram post reflected Nylon’s independent opinion about the","source":"FTC USA Business Blog Posts","pubDate":"Wed, 07 Oct 2026 14:05:06 +0200","titre":"FTC’s Lord & Taylor case: In native advertising, clear disclosure is always in style","url":"https://www.ftc.gov/business-guidance/blog/2016/03/ftcs-lord-taylor-case-native-advertising-clear-disclosure-always-style"},{"id":3199079,"description":"Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document lfair May 23, 2023 | 6:41PM Franchise Fundamentals: Taking a deep dive into the Franchise Disclosure Document By Lesley Fair Love at first sight may (or may not) be a real thing, but when it comes to investing your money, it’s unwise to fall for a franchise without first subjecting it to tough-minded scrutiny. The third in the FTC’s Franchise Fundamentals blog series walks through an essential part of that evaluation: an in-depth review of the Financial Disclosure Document (FDD) required by the FTC’s Franchise Rule . You must receive the Franchise Disclosure Document at least 14 days before you’re asked to sign any contract or pay any money to the franchisor or one of its affiliates. In fact, you have the right to the FDD once the franchisor has received your application and agrees to consider it. So speak up if you don’t receive it and ask questions – lots of them – as you review the FDD and any attached documents.   Image Indeed, the franchisor’s conduct regarding the FDD may raise some red flags about how they do business. Providing the FDD doesn’t establish that a franchisor is reputable – it’s required by law, after all – but if a franchisor doesn’t promptly provide this mandatory document, gives you an incomplete FDD, evades your probing questions, or tries to rush you through the process, it doesn’t speak well of their approach to legal compliance.  Assuming you have the FDD in hand, let’s consider some of the 23 required items line by line. Here are things to look for as you review the FDD. Franchisor’s Background (FDD Item 1) Item 1 provides background information about the franchisor and any parent companies, predecessors, and affiliates, including how long the franchise has been in business. It also lets you know if there are any legal requirements unique to the franchised business, like the need to get a special license or permit. This can help you understand the costs and risks you would be taking on. Business Background (FDD Item 2) Remember the old adage “People are known by the company they keep”? Well, companies are known by the people they keep, which is why Item 2 identifies directors, principal officers, and other key executives. Pay attention to their business backgrounds, their experience in managing a franchise system, and how long they’ve been with the franchisor. Litigation History (FDD Item 3) Item 3 lists information about prior litigation, including whether the franchisor or any of its executive officers have been convicted of certain crimes or have been found liable – or settled lawsuits – related to the franchise relationship. Lawsuits against the franchisor could mean it hasn’t honored its agreements or that franchisees are dissatisfied with its performance. Item 3 also says whether the franchisor has sued any of its franchisees in the past year. That information could suggest problems in the franchise system. For example, if a franchisor sued franchisees for failing to pay royalties, was it because franchisees weren’t successful and couldn’t make their royalty payments? Bankruptcy (FDD Item 4) Have the franchisor, its affiliates, or any of its executives filed for bankruptcy? Item 4 discloses that information and could give you insights into the financial condition of the business.  Initial and Other Fees (FDD Items 5-7) Items 5-7 go over some of the costs involved in starting and operating a franchise. That could include things like deposits or franchise fees (some of which may be non-refundable); what you’ll have to pay for initial inventory, signs, equipment, leases, or rentals; and ongoing costs, like royalties and advertising fees. Instant Checkmate marketed its reports as a way for prospective employers and landlords to investigate applicants.  For example, the company advertised that one of the “GOOD REASONS to get instant criminal checks on anyone right now” was to “check out tenants before they rent.”  It also used a Google Ad Words campaign to make sure its site appeared when people searched for background checks on nannies, babysitters, maids, and housekeepers.  What kind of information would buyers get?  Current and previous addresses, birth certificates, arrest histories, and marriage and divorce records, to name just a few examples. InfoTrack offered similar services to employers nationwide, including background screening reports with people’s driving records, education and employment information, criminal histories, and even records from sex offender registries. How does the FCRA come in?  The law defines a “consumer report” as a “communication of any information” by a consumer reporting agency (CRA) that bears on a person’s “credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living” which is used (or expected to be used) as a factor in establishing their eligibility for credit, insurance, employment, or other reasons outlined in the law. According to the FTC, what Instant Checkmate and InfoTrack were doing triggered the FCRA.  For example, companies covered by the law must follow procedures to assure their reports are as accurate as possible, must take steps to see that those using their reports have permissible purposes for accessing them, and must provide required User Notices explaining key protections for consumers.  The law imposes special requirements when CRAs provide reports containing public record information that could have an adverse effect on a person’s ability to get a job.  In that case, the CRA must either: 1) notify the consumer that it’s reporting the information in the public record; or 2) maintain “strict procedures” – that’s the language in the law – designed to ensure the reported public information is complete and up to date. You’ll want to read the complaints for specifics of where the FTC says the companies fell short, but one example cited in the lawsuit against InfoTrack offers an object lesson on why FCRA protections are so important to consumers – and how the consequences can be devastating when companies don’t live up to the law.  According to the FTC, the reports InfoTrack provided to prospective employers included information about whether a job applicant was on the National Sex Offender Registry.  The employer would provide the first and last name and the date of birth to help InfoTrack with its search.  The problem was that before the fall of 2011, no date of birth was available for many names on the Registry.  If InfoTrack’s search found more than one person with the same first and last name, it reported a “possible match” to employers and gave them reports that included several different people with the","source":"FTC USA Business Blog Posts"},{"pubDate":"Sat, 03 Oct 2026 08:09:37 +0200","titre":"Company to pay $22 million for offering \"free\" credit scores that turned out to be not so free","url":"https://www.ftc.gov/business-guidance/blog/2014/11/company-pay-22-million-offering-free-credit-scores-turned-out-be-not-so-free","source":"FTC USA Business Blog Posts","id":3194913,"description":"Company to pay $22 million for offering \"free\" credit scores that turned out to be not so free wfg-adm109 November 19, 2014 | 11:12AM Company to pay $22 million for offering \"free\" credit scores that turned out to be not so free By Lesley Fair We’ve brought law enforcement actions – dozens of ‘em. We’ve held workshops, issued reports, and sent warning letters. If it takes sky writing, tap dancing, and a float in a Thanksgiving Day parade, we’ll do that, too. But here’s what’s not going to happen. The FTC is not giving up until businesses get the message that: 1) Free means free; and 2) Key terms and conditions have to be clearly and conspicuously disclosed. A $22 million settlement announced by the FTC and the AGs of Illinois and Ohio with a national credit monitoring service advertising so-called “free” credit scores emphasizes that point. Another note for practitioners: It's the FTC's third case alleging violations of ROSCA . One Technologies and related outfits marketed their credit monitoring programs, MyCreditHealth and ScoreSense, through at least 50 sites, including FreeScore360.com, FreeScoreOnline.com and ScoreSense.com. Their strategy was simple. Buy advertising on search engines so their ads show up near the top when people look for phrases like “free credit report\" and then follow up with a persuasive pitch: “View your latest Credit Scores from All 3 Bureaus in 60 seconds for $0!” According to the lawsuit , the defendants failed to clearly tell consumers that if they availed themselves of those “free” services and didn’t cancel within seven days, the defendants would ding their credit cards for $29.95 a month over and over and over again. The complaint includes screen shots of the defendants’ sites, but before looking at them, take out your reading glasses because they’ll come in handy in trying to locate where the defendants chose to tell people about that $29.95 monthly fee. One line of fine print added in late 2012 said “Free 7-Day trial when you order your 3 Free Credit Scores. Membership is then just $29.95 per month until you call to cancel.” The first problem: The type was tiny – a fraction of the size of the defendants’ multiple use of the word “free.” The second problem: Why should consumers even have to be on the look-out for the cost, given that the defendants so prominently advertised it as “free”? A second purported disclosure appeared as an obscure hyperlink on the page where people typed in their Social Security number and birthdate.  Sandwiched between the logos of various security firms and a large color button that said CONTINUE was this less-than-crystal-clear statement: By clicking on the ‘Continue’ button, you agree to the Offer Details, to the Terms and Conditions, acknowledge receipt of our Privacy Policy and agree to its terms . . . The “Offer Details” link triggered a small pop-up that said, among other things, “At the end of the 7-day trial period, your credit/debit card will be charged $29.95 on a monthly basis until you call to cancel.” Another place the defendants put the information was on a side panel of the Payment Form in white letters on a grey background – a color combination one of the defendants’ own employees described as “known to cause seizures in lab rats.” According to the complaint, once people spotted the unauthorized charges on their accounts, the defendants didn’t make it easy to stop the billing.  And even when people asked for their money back because they hadn’t approved of the charges, the defendants denied refunds to many of them. The lawsuit alleges violations of the FTC Act, as well as the Illinois Consumer Fraud Act, the Ohio Consumer Sales Practices Act, and related state rules. In addition, the complaint is the third FTC action to charge violations of ROSCA, the Restore Online Shoppers’"},{"titre":"The EBA publishes its 2027 Work Programme","url":"https://www.eba.europa.eu/publications-and-media/press-releases/eba-publishes-its-2027-work-programme","pubDate":"Thu, 01 Oct 2026 08:17:03 +0200","description":"The European Banking Authority (EBA) published today its Work Programme outlining the key areas of focus and deliverables for 2027. In addition, we know that the process of dying and death, at least in a healthcare context, is different based on where it happens, to whom it happens, and why it happens. We know that the process remains heavily medicalised, with calls to understand dying and death more relationally, culturally, socially, and philosophically. There is a great benefit in disciplines working together to promote cross-jurisdictional perspectives and methodologies, and to prioritise interdisciplinary thinking and research on end-of-life issues, for the benefit of society, the individual, healthcare professionals, and healthcare itself. Our contribution to this special issue on end-of-life for the Journal de Droit de la Santé et de l’Assurance Maladie serves a small part in this bigger goal for an interdisciplinary approach to end-of-life discourse and research. It brings together perspectives from 9 jurisdictions, from 17 academics from the disciplines of law, medicine, philosophy, criminology, sociology, to contribute to one very important end-of-life choice: assisted dying and assisted death. A ‘good-quality death’ depends on our relationships, achievements, values and the meaning we create. A good-quality death is not necessarily one without sadness or loss. Rather, it is a death marked by dignity, minimal suffering, and respect for personal autonomy. Good, quality end-of-life care and death need a deeper theoretical foundation, including consideration on concepts such as life cycles, changing relationships between the living and the dead, new technologies and new ways of dealing with the body and death, and cultural attitudes to death and dying. The contributions in this issue are based on a workshop that was hosted by the Brocher Fondation in January 2025 in Geneva, Switzerland led by the two of us. Following our Brocher-sponsored workshop, and having discussed the idea as early as the summer of 2022 (when we first met), we decided to establish the European End-of-Life Research Network (EuEOLNet), a Network that brings together scholars from across Europe to exchange on end-of-life. Specifically on the matter of assisted dying and assisted death, an increase in regulation of this end-of-life choice can be noted globally, including in Europe. Regulated access to a form of assisted death in Europe is, at the time of writing, available in Switzerland, the Netherlands, Belgium, Luxembourg, Austria, Portugal, Spain and Slovenia. In practically all jurisdictions, it is a form of medical-assisted dying. Discussion is underway in many jurisdictions, including France, Germany, Italy, England and Wales, Scotland, the Isle of Man and Jersey, the Czech Republic. With this special issue, we aim to share the latest developments on assisted dying regulation in some selected jurisdictions and comment on its key regulatory features and"},{"source":"Federal Trade Commission - Protecting America's Consumers","description":"New data from the Federal Trade Commission reveal that people reported losing a staggering $3.5 billion to imposter scams in 2025, with reported losses increasing nearly three times since 2020. FTC data also show that people reported imposter scams more than any other fraud category in 2025—nearly one in three fraud reports were about imposter scams. These scams lured consumers through text, phone, email, social media, search engine results and other means. Some of the costliest impersonation scams start with a fake security alert, often from a bank. People are convinced to move money to “protect” it, with their losses often limited only by their available funds. Last year, people reported losing nearly $1 billion to business impersonators with the highest reported losses to bank impersonators—and about $920 million to government impersonators, up from $866 million and $789 million respectively in 2024. The FTC has seen a striking increase in reported fraud losses to all types of fraud—about $16 billion was reported lost in 2025, the highest on record and an increase of about 25% compared to the 2024 figure. “Consumers derive enormous benefits from competitive markets built on truthful information. But fraud undermines that foundation, impeding the market process and preventing markets from operating efficiently,” said Christopher Mufarrige, Director of the Bureau of Consumer Protection. “The FTC will use every tool available to combat one of the most pernicious forms of fraud—government and business impersonation—and to protect the integrity of the digital economy.” The data underscore the importance of the FTC’s work with the  Elder Justice Coordinating Council (EJCC) , which is working to help raise awareness of imposter scams and other scams impacting older adults as well as other consumers. This year, the FTC, along with the Department of Justice, Department of Health and Human Services and members of the EJCC, is leading the Never Ever campaign, a public-private coordinated consumer education effort to raise awareness of government and business imposter scams. In addition to the federal agency members of the EJCC , the campaign also includes private sector representatives such as the American Bankers Association, USTelecom, Google and Microsoft. To help the public spot imposter scams, EJCC members launched the Never Ever campaign, which is aimed at promoting messaging on the key actions that government and businesses will Never Ever take. The Never Ever campaign will run from June 15 to June 26, in conjunction with World Elder Abuse Awareness Day. This first-of-its-kind public-private partnership includes participants from a wide range of organizations and is aimed at directing consumers to a website that includes information and resources to help them avoid imposter scams and what to do if they spot one. Enforcement Actions To help combat impersonation scams, the FTC in 2024 finalized the Impersonation Rule. The Rule gives the agency stronger tools to combat and deter scammers who impersonate government agencies and businesses, enabling the FTC to file federal court cases seeking to get money back to injured consumers and civil penalties against rule violators. Since then, the FTC has vigorously enforced the rule and brought a dozen enforcement actions that have resulted in halting imposter schemes and obtained over $70 million in redress for consumers. In 2025, the FTC brought law enforcement actions under the Impersonation Rule against:  American Tax Service (IRS imposter scheme);  MediaAlpha (government imposter scheme to sell health insurance);  Click Profit (business imposter money making scam);  Blackstone Legal (phantom debt business imposter scheme) and  Accelerated Debt Settlement (government and business imposter scheme that targeted older adults for debt relief). At the BEREC public debriefing on 10 June, the BEREC Chair, Marko Mismas (AKOS, Slovenia), and the Working Group Co-Chairs presented BEREC’s assessment of the DNA proposal, outlining key regulatory considerations that emerged from its analysis. BEREC welcomes the ambition of modernising the EU connectivity framework and supporting resilient, sustainable and high-quality digital networks. At the same time, the assessment highlights areas where further refinement may be needed to ensure that the future framework strengthens rather than adds unnecessary complexity to the internal market for electronic communications. BEREC has developed thematic papers examining key elements of the proposal in greater depth, supporting evidence-based input to the co-legislators. To further contribute to the policy debate, BEREC will publish three additional thematic papers by the end of June. BEREC remains committed to providing its technical and regulatory expertise to help shape a competitive, innovative and future-proof digital Europe. 5G slicing guidance BEREC experts look forward to receiving stakeholders’ input to the public consultation on the draft further guidance on 5G network slicing by 6 August 2026. The draft guidance aims to provide greater regulatory certainty for market players and support innovation in 5G services, while safeguarding open internet principles. Building on the existing Open Internet framework, the guidance will assist providers in assessing whether network slicing-based services comply with the Regulation, including in relation to internet access and specialised services. Reflecting the principle of technological neutrality, the approach is intended to remain relevant beyond 5G and to apply to other technologies that use comparable quality-of-service mechanisms. Call for inputs on roaming BEREC has issued a call for inputs regarding its work on roaming. This call aims to support the preparation of BEREC’s Opinion for the European Commission on the upcoming review of the EU Roaming Regulation and the Implementing Regulation on Fair Use Policy and Sustainability, which is scheduled for submission by the first quarter of 2027. Building on its 2025 Opinion, BEREC invites stakeholders to provide new information, evidence, and perspectives by 21 August 2026. In addition, following the consultation on possible amendments to the BEREC Roaming Benchmark Data Collection procedure, BEREC decided to maintain the current quarterly data collection approach. However, the expansion of the Roam-Like-at-Home regime to Ukraine and Moldova on 1 January 2026, together with the simplification proposals in BEREC’s 2025 Opinion on the Roaming Regulation, requires an update of the roaming data collection template. BEREC therefore launched a call for input on the revised template and invites operators to submit their comments by 3 July 2026. Emergency communications resilience Ensuring uninterrupted access to emergency services for end users remains a critical priority as 2G and 3G mobile networks are progressively phased out across Europe. During its latest plenary meeting, the Heads of the European regulators for electronic communications discussed and adopted a BEREC statement addressing concerns that some devices may fail to connect to emergency communications services, including 112, once legacy networks are switched off. The statement aims to raise awareness of the issue and calls for closer cooperation across the entire communications ecosystem. BEREC underlines the need for further investigation, improved detection of potential failures, and greater transparency among stakeholders to help safeguard the reliability of emergency communications throughout the technological","pubDate":"Thu, 11 Jun 2026 10:23:49 +0200","titre":"BEREC presents its assessment of the Digital Networks Act proposal","url":"https://www.berec.europa.eu/en/news/press-releases/berec-presents-its-assessment-of-the-digital-networks-act-proposal"},{"description":"Key Drivers Behind the Rising Demand for Virtual CISOs Wednesday, April 22,2026 Businesses are navigating the challenges of a digital-first environment, which is driving an increased demand for expert-driven cybersecurity solutions. In addition, the Board has created a team to speed up the finalisation of the guidelines on anonymisation. The EDPB has also adopted two opinions on the two sets of the Europrivacy certification criteria for approval as European Data Protection Seals, one of which to be used as a tool for transfers. Many areas of scientific research rely on the processing of individuals’ personal data, and this has driven significant scientific breakthroughs that benefit society. The rise of new technologies, such as artificial intelligence, also contributes to scientific progress by enabling researchers to use and analyse data in innovative ways. The main objective of the EDPB guidelines on scientific research is to provide more clarity for researchers and make GDPR compliance easier , while ensuring the protection of individuals’ fundamental rights . “Scientific research can drive societal progress and improve our daily lives.  Our guidelines facilitate innovative research by helping researchers to navigate the GDPR. The EDPB is committed to supporting the scientific community and unlocking the full potential of scientific research in the EU while upholding data protection rights.\" EDPB Chair, Anu Talus In its guidelines, the Board provides clarifications on the concept of ‘scientific research’ . To determine if the processing takes place for scientific research purposes in the meaning of the GDPR, the Board provides six key-indicative factors that should be considered, in addition to the nature, scope, context and purposes of processing. These are: 1) methodical and systematic approach, 2) adherence to ethical standard, 3) verifiability and transparency, 4) autonomy and independence, 5) objectives of the research, and 6) potential to contribute to existing scientific knowledge or apply existing knowledge in novel ways. If the research activities meet these six factors, they can be presumed to constitute scientific research. Otherwise, the controller should justify and be able to demonstrate why the activities should be considered scientific research, within the meaning of the GDPR. Further processing for scientific research purposes is presumed to be compatible with the initial purpose for collecting individuals’ personal data. Therefore, controllers are not obliged to do the purpose compatibility test under the GDPR to determine if the new processing is compatible with the original purpose of collection. However, controllers must still make sure that the legal basis of the initial processing is also suitable for the further processing of personal data for scientific research purposes. Controllers can rely on “broad consent” where the purposes of research are not fully known at the time of collecting the personal data. In this case, researchers should respect ethical standards for scientific research and put additional safeguards in place to compensate for the lack of purpose specification. Controllers can also ask individuals to consent to different individual research projects separately, as soon as the purposes of those projects become known (dynamic consent). A combination of both broad and dynamic consent is also possible. In addition, the EDPB clarifies rights of individuals when their personal data are processed for scientific purposes. This includes the rights to erasure and object for which limitations may apply when personal data are processed for scientific research purposes. The Board provides examples to explain when the right to erasure can be considered likely to render impossible or seriously impair the objective of conducting scientific research. The EDPB also explains when controllers may reject an individuals’ objection to the processing of their personal data for scientific research purposes. This can be the case when processing is necessary for the performance of a task carried out for reasons of","id":2829942,"source":"EDPB News","url":"https://www.edpb.europa.eu/news/news/2026/edpb-brings-clarity-data-processing-scientific-research-speeds-finalisation_en","titre":"EDPB brings clarity to data processing for scientific research, speeds up the finalisation of the anonymisation guidelines and approves first European data protection seal as a tool for transfers","pubDate":"Thu, 16 Apr 2026 14:15:11 +0200"},{"id":2816021,"description":"Brussels, 09 April - The European Data Protection Board (EDPB) has published its  2025 Annual Report . The report provides an overview of the EDPB work carried out in 2025 and reflects on important milestones, such as the adoption of the  Helsinki Statement on Enhanced Clarity, Support, and Engagement . “In 2025, we saw the data protection landscape change significantly. The rapid expansion of the EU’s digital regulatory framework has added complexity to the data protection ecosystem. To help organisations navigate this complexity and support compliance, the EDPB focused on enhancing legal certainty, making compliance more achievable in practice, and strengthening cooperation, both among Data Protection Authorities and with other regulators.  We also prioritised meaningful dialogue with stakeholders to ensure our work reflected real-world needs. Our achievements support economic growth while continuing to protect individuals’ fundamental rights to privacy and data protection.” EDPB Chair, Anu Talus   The Helsinki’s statement initiatives leading the way In 2025, the EDPB worked actively to address the demand for regulatory simplification to support innovation and economic growth, while ensuring the protection of individuals’ personal data.  With this in mind, the Board adopted the  Helsinki Statement on Enhanced Clarity, Support, and Engagement , which outlines new initiatives to  make GDPR compliance easier, strengthen consistency, enhance the dialogue and improve transparency with stakeholders and boost cross-regulatory cooperation .   For example, the Board launched a public consultation to ask organisations which templates would be most useful, organised several stakeholder events to consult organisations on upcoming guidelines and systematically published reports on stakeholder input.    Easing compliance for organisations and providing legal advice In the context of ongoing discussions on regulatory simplification at EU level, the EDPB actively contributed to legislative initiatives aimed at reducing administrative burden and streamlining requirements. The Board adopted a  joint opinion with the European Data Protection Supervisor (EDPS) on the Commission’s Proposal for a Regulation amending certain regulations, including the GDPR.  In addition, the Board held important discussions on this matter during plenary meetings, which subsequently informed the  EPDB/EDPS joint opinions on the Commission’s proposals on the  Digital Omnibus and on the  Digital Omnibus on AI adopted at the beginning of 2026. The Board also delivered five adequacy-related opinions concerning United Kingdom, Brazil and the European Patent Organisation (EPO).  In addition, the Board adopted  Recommendations on the legal basis for requiring the creation of user accounts on e-commerce websites , and  Recommendations on the 2027 WADA World Anti-Doping Code  upon request from the Commission.   Strengthening cross-regulatory cooperation Cross-regulatory cooperation was a key focus for the EDPB last year. The EDPB worked together with the European Commission to clarify how data protection and digital laws interact and to address legal and practical challenges in cross-sectoral cases. Although lane splitting is not allowed everywhere in France, it is a common riding practice among motorcyclist drivers. As transport policy is a key driver for promoting sustainable and safe transport, a first experiment (2015-2018) was conducted in eleven departments where a secure form of lane splitting was allowed on highways and urban expressways (Eyssartier et al., 2018). A second experiment is conducted since 2021 in ten new departments with eight specific conditions regulating this practice. The aim of this article is to present the results of this second experiment by analyzing the social acceptability of this road safety policy. This involves studying acceptability and therefore identifying the factors impacting the general attitude towards the measure and the behavioral intention to comply with the rules, based on the Unified Theory of Acceptance and Use of Technology developed by Venkatesh et al. (2003). We performed multiple regressions on several dependent variables: general attitude toward the measure for car and motorcyclist drivers and intention to respect the rules for motorcyclist drivers. Overall, the results show that drivers have a positive general attitude to the rules, and that this attitude is more positive for motorcyclists than among car drivers. No differences were found between experimental departments and control departments. The results indicate that the expected effort factor, which refers to perceived ease, and the efficacy in terms of road sharing, are the most relevant to explain the intention to comply with the measure and the attitude toward the rule. BEREC welcomes the overarching ambition to modernise the regulatory framework for Europe’s connectivity sector and to support resilient, sustainable and high quality digital networks. At the same time, BEREC identifies important areas where further refinement is needed to ensure that the DNA strengthens, rather than complicates, Europe’s internal market for electronic communications. BEREC stands ready to provide its regulatory expertise in order to avoid undue complexity or uncertainty and to ensure that the final framework delivers a competitive, connected and resilient digital Europe. BEREC welcomes the updated objectives introduced by the DNA , including resilience, sustainability, in addition to the existing objectives addressed by the European Electronic Communications Code. While BEREC supports the ambition to strengthen the competitiveness of the EU digital sector, it highlights that this can only be achieved through an effective and robust competition framework. It further notes that the proposal introduces elements of greater centralisation that require further clarification to ensure they contribute effectively to a well functioning internal market. While BEREC recognises the Commission’s intention to streamline the General Authorisation procedures, the proposed Single Passport mechanism raises concerns from several perspectives. In particular, by concentrating significant enforcement responsibilities in the Member State of first notification, the system risks forum shopping, uneven supervisory burdens and slower enforcement. Overall, BEREC considers that the proposal could introduce greater operational complexity, administrative burden and legal uncertainty, without offering clear benefits over the current straightforward authorisation regime. BEREC also notes that the DNA proposes major changes to spectrum management , including treating spectrum as an EU‑level resource and introducing common rules for fees, long‑duration rights and satellite authorisation. While these measures aim at harmonisation, BEREC warns that the proposed single market procedure, which includes a Commission veto, signifies a notable trend towards centralisation and raises certain concerns. BEREC also cautions that some proposals in particular the introduction of unlimited license duration and automatic renewals, risk favouring existing rights holders and reducing market contestability. On the other hand, it welcomes it proposed role in the market shaping aspects of spectrum assignment. On satellite authorisation, BEREC supports EU coordination but stresses the need for alignment with ITU‑R rules. The DNA’s move to treat numbering resources as a common Union asset introduces a more centralised approach, and while BEREC sees potential benefits in greater harmonisation, it notes that key concepts—such as an EU wide numbering plan and pan European numbering ranges—require further clarification. BEREC also considers that additional analysis of demand, use cases and operational impacts would help ensure that any new framework is aligned with the needs of end users, operators and regulators. BEREC welcomes the preservation of the Significant Market Power regime, a cornerstone of the EU regulatory model, alongside the continued availability of symmetric access tools . Nonetheless, several DNA proposals, including new sequencing rules for remedies, the potential removal of the Recommendation on Relevant Markets, and expanded Commission veto powers could reduce the ability of NRAs to address national market needs. BEREC supports the goal of enabling a smooth transition from copper to fibre networks and recognises improvements made to","id":2793006},{"id":2792998,"description":"Public consultation on the draft BEREC Report on Virtual Worlds and Web 4.0 yannick.stephan Tue, 17/03/2026 - 09:26 Breadcrumbs Public Consultations & Calls for Inputs Deadline: Monday, 20 April 2026 (17:00 CEST) During the 66th BEREC plenary meeting (12-13 March 2026), the Board of Regulators approved the Draft BEREC Report on Virtual Worlds and Web 4.0 (BoR (26) 39) for public consultation. The report in a nutshell Virtual worlds (VW) and web 4.0 are at the basis of a transition to the 4th generation of internet based services, leading toward industry 4.0 and smart society. This shift is driven by artificial intelligence (AI) integration in networks and services. Hence, web 4.0 and immersive services are meant to have a significant economic and social impact by transforming the way in which industrial production evolves and automates its processes. At the same time, they transform the fruition of online content and applications by users. This draft BEREC Report provides a fully-fledged analysis. The first part of the draft Report dives into the connectivity developments as well as the transition to network-as-a-service (NaaS). It also provides examples of use cases cutting across industrial and societal applications. The second part deals with challenges posed to electronic communications networks/services (ECN/S) operators related either to the investment lines or to business models and market positioning. In such a scenario, focus is dedicated also to regulatory challenges, for instance the need to guarantee openness and interoperability and to foster investment. The Report builds on previous BEREC work, including the high-level position on artificial intelligence and virtual worlds provided as a contribution to the call for inputs on competition in generative AI and VW issued in 2024 by the European Commission (EC). The report is framed in the following 5 chapters and Conclusion: Introduction Chapter by providing a definition for VW, based on its key characteristics; Chapter 2 provides some concrete examples of use cases; Chapter 3 describes the connectivity challenges faced to enable VW and the network upgrades; Chapter 4 assesses the potential role of electronic communication providers in the provision of VW/Web 4.0 services, as well as any possible future profit streams and incentives; Chapter 5 examines the potential electronic communications regulatory challenges that may arise. Following a year-long coordinated action on the right to erasure in 2025 , the CEF's focus this year will shift to compliance with the obligations of transparency and information under the GDPR . The GDPR ensures that individuals are informed when their data is being processed (under Art. 12, 13 and 14). This right to be informed is a core element of transparency and ensures that individuals have more control over their data. Next steps During 2026, 25 Data Protection Authorities (DPAs) across Europe will take part in this initiative. They will look closely to assess the compliance of controllers with their transparency obligations under the GDPR. Participating DPAs will soon contact controllers from different sectors across Europe, either through enforcement actions or fact-finding exercises. In the latter case, they might also decide to undertake additional follow-up actions if needed. During the second half of the year, participating DPAs will share and discuss their findings together, with a view to aggregate the results of their national actions and generate deeper insight into the topic. A consolidated report will then be drafted and submitted for adoption by the EDPB, allowing for targeted follow-ups on both national and EU levels. Background The CEF is a key action of the EDPB under its 2024-2027 Strategy , aimed at streamlining enforcement and cooperation among DPAs. In 2023, the EDPB published the report on its first coordinated action on the use of cloud-based services by the public sector . In 2024, the EDPB also published the report on the outcome of the second coordinated action on the designation and position of Data Protection Officers . In 2025, the EDPB issued the report on its third coordination action on the implementation of the right of access . In 2026, the EDPB has adopted a report on its Coordinated Enforcement Framework (CEF) action on the right to be forgotten (Art.17 GDPR) .   Note to editors: *The Board selected this topic during its October 2025 plenary","source":"EDPB News"},{"description":"Brussels, 18 February - The European Data Protection Board (EDPB) has adopted a  report on its Coordinated Enforcement Framework (CEF) action on the right to be forgotten (Art.17 GDPR) .  The  Board selected this topic  as it is one of the most frequently exercised GDPR rights and one about which DPAs frequently receive complaints from individuals. The main objectives of this coordinated action are to ensure that the right to erasure is effectively exercised by individuals in Europe and understand how controllers comply with this right in practice. In addition, the EDPB identified good practices and the most important related challenges, with the aim of providing further guidance on this topic.  Throughout 2025, 32 DPAs across Europe took part in this initiative. More specifically, 9 DPAs have initiated new formal investigations or have continued ongoing ones, and 23 DPAs carried out a fact-finding exercise. A total of 764 controllers across Europe responded to the action, ranging from small and medium-sized enterprises (SMEs) to big companies active in many different industries and fields, as well as various types of public entities. The results of these national actions have been aggregated and analysed together allowing for targeted follow-up on both national and EU level.   Areas of improvement and main challenges The report lists the issues that were identified, along with a series of recommendations addressed to controllers, to help them implement the right to erasure. Seven recurring main challenges were identified by DPAs. The results confirmed some of the findings of the 2024 coordinated action on the right of access , for example when it comes to the lack of appropriate internal procedures to handle requests, or the lack of sufficient information provided to individuals. In addition, participating DPAs reported specific findings related to the reliance by some controllers on inefficient anonymisation techniques to handle erasure requests as an alternative to deletion. DPAs also noted inconsistent practices, and the difficulties faced by controllers regarding the determination of retention periods and the deletion of personal data in the context of back-ups. In addition, as the right to erasure is not an absolute right, some controllers face difficulties in assessing and applying the conditions for the exercise of this right, including in carrying out the different balancing tests between the right to erasure and other rights and freedoms.   Follow-up to help organisations comply  Extensive guidance, documents and templates exist at national level to help controllers comply with the right of erasure and help individuals exercise this right. In line with the Helsinki Statement’s objectives of making GDPR compliance easier and ensuring consistent interpretation and enforcement across Europe, the extensive guidance and templates already available at national level will be leveraged at EDPB level where appropriate.   Background and next steps The CEF is a key action of the EDPB under its 2024-2027 Strategy , aimed at streamlining enforcement and cooperation among DPAs.  In 2023, the EDPB published the report on its first coordinated action on the  use of cloud-based services by the public sector . This meeting marked the second of its kind, following the first gathering in October 2024 . An adequacy decision is a key-mechanism in EU data protection legislation which allows free flow of personal data from Europe to third countries or an international organisation offering an adequate level of data protection.* To date, the following countries and organisation benefit from this:   Andorra, Argentina, Canada, Faroe Islands, Guernsey, Israel, Isle of Man, Japan, Jersey, New Zealand, Republic of Korea, Switzerland, United Kingdom, Uruguay, United States, and the European Patent Organisation . The French SA carried out investigations on SOLOCAL MARKETING SERVICES which got prospect data mainly from data brokers, publishers of game contests and product testing sites (these actors are the first links in the chain, the primary collectors, who are responsible for collecting prospect data). In addition, the Board adopted an opinion on the European Commission’s proposal to extend the validity of the UK adequacy decisions under the GDPR and the Law Enforcement Directive (LED) . Finally, the EDPB agreed to grant the status of observer to the Personal Data Protection Agency of Bosnia and Herzegovina.   Adequate protection of personal data by the EPO At the European Commission’s request, the Board adopted an opinion on the Commission’s draft adequacy decision regarding the European Patent Organisation (EPO). Once formally adopted by the Commission, this will be the first adequacy decision concerning an international organisation and not a country or a region. An adequacy decision is a key-mechanism in EU data protection legislation which allows the European Commission to determine whether a third country or an international organisation offers an adequate level of data protection. The effect of such a decision is that personal data can flow freely from Europe to that third country or international organisation. EDPB Chair, Anu Talus, said: “The EDPB welcomes the Commission’s initiative to work on the first adequacy decision concerning an international organisation. This decision shows how the legal framework of such organisations can be recognised as ensuring an adequate level of protection on the basis of Art.45 GDPR. The EDPB underlines the importance of ongoing dialogue between the Commission and international organisations, with a view to developing this category of adequacy decisions in addition to those relating to third countries.” In its opinion, the Board positively notes that the EPO data protection framework is largely aligned with the European Union data protection framework, including on data protection rights and principles. This shows that the GDPR and, in particular, its transfer provisions, can facilitate safe data flows from Europe to international organisations, while taking into account their status.   Six-month extension of the UK adequacy decisions The EDPB opinion, requested by the European Commission, addresses the proposed extension of the two UK adequacy decisions under the GDPR and the LED, which are set to expire on 27 June 2025. The opinion only concerns the proposed 6-month extension of these adequacy decisions and does not address the level of protection for personal data afforded in the UK, which will be examined by the EDPB following the Commission’s assessment, and if the renewal of the UK adequacy decisions is proposed. Since the UK‘s data protection reform is still pending in the UK parliament, the EDPB recognises the need for a technical and time-limited extension of the adequacy decisions until 27 December 2025.This will give the European Commission sufficient time to evaluate the updated UK legal framework once it has been adopted.   The EDPB stresses that this extension is exceptional and is due to the ongoing legislative developments in the UK. It should not, in principle, be further prolonged. The Board recalls the validity of its opinions 14/2021 and 15/2021 on the two UK adequacy decisions, adopted in April 2021, and invites the European Commission to take them into account in its future assessments.  The Board also recalls the Commission’s obligation to monitor all relevant developments in the UK during the extension period.   New observer to the EDPB’s activities Finally, EDPB members agreed to grant observer status to the EDPB’s activities to the Bosnia and Herzegovina Data Protection Authority, in line with Art. 8 EDPB Rules of Procedure .","pubDate":"Tue, 06 May 2025 15:51:59 +0200","url":"https://www.edpb.europa.eu/news/news/2025/european-patent-organisation-and-extension-adequacy-decisions-uk-edpb-adopts_en","titre":"European Patent Organisation and extension of adequacy decisions for the UK: EDPB adopts opinions"},{"source":"EHPM","description":"EHPM proudly presents its Annual Report 2024, offering an in-depth review of the organisation’s key activities, achievements, and strategic vision. The report summarises the outcome of a series of coordinated national actions carried out in 2024 under the Coordinated Enforcement Framework (CEF). It lists the issues that were observed for some controllers, along with a series of recommendations to help them implement the right of access. A central element is controllers’ awareness of the EDPB Guidelines 01/2022 on data subjects rights – Right of access and whether these guidelines were followed in practice. EDPB Deputy Chair Zdravko Vukíc said: “The CEF is a valuable initiative that helps strengthen the cooperation among Data Protection Authorities (DPAs): by tackling selected topics in a coordinated fashion, they achieve greater efficiency and more consistency. How controllers implement the right of access lies at the heart of data protection and it is one of the most frequently exercised data subject rights.” Throughout 2024, 30 DPAs across Europe launched coordinated investigations into the compliance of controllers with the right of access, by opening formal investigations, assessing whether a formal investigation was warranted and/or carrying out fact-finding exercises.  A total of 1,185 controllers, consisting of small and medium-sized enterprises (SMEs) and big companies active in different industries and fields, as well as various types of public entities, responded to the action. Areas of improvement and main challenges The results suggest that more awareness raising about Guidelines 01/2022 is necessary , both at national and EU level, as the guidelines help controllers implement the right of access, explain how exercising this right can be made easier, and list the exceptions and limitations of the right to access. As a result of the 2024 CEF action, seven challenges were identified. One of them is the lack of documented internal procedures to handle access requests. In addition, inconsistent and excessive interpretations of the limits to the right of access were also observed, such as overly relying on certain exceptions to automatically refuse access requests. Another example is the barriers that individuals could encounter when exercising their right of access, such as  formal requirements or being requested to provide excessive identification documents. For each challenge identified, the report provides a list of non-binding recommendations to be taken into account by controllers and DPAs. Positive findings Despite the existing challenges, two thirds of participating DPAs evaluated the level of compliance of responding controllers with respect to the right of access from ‘average’ to ‘high’. One important factor identified as having an impact on the level of compliance was the volume of access requests received by controllers, as well as the size of the organisation. More specifically, large-sized controllers or controllers receiving more requests were more likely to reach a higher level of compliance than small organisations with less resources. Positive findings were observed across Europe. These include the implementation of best practices by controllers, such as user-friendly online forms enabling individuals to submit an access request easily as well as self-service systems to allow individuals to autonomously download their personal data in a few clicks and at any time. Background and next steps The CEF is a key action of the EDPB under its 2024-2027 Strategy, aimed at streamlining enforcement and cooperation among DPAs.  In the past three years, two previous CEF actions were carried out.
