In recent years, a number of mentoring or awareness campaigns have been put in place to encourage French high school students to study maths, physics or engineering sciences, while they remain underrepresented in these fields. One of the last large-scale initiatives is the Filles et Maths program , launched in 2025, including work on gender bias, the implementation of “role models” or timetables featuring flexible hours. The program was nonetheless met with criticism: while women remain under-represented in some disciplines, they also remain a minority in the highest positions across the board in the academic world, from mathematics to social sciences. In France, gender inequalities are therefore not limited to access to scientific studies: they cut across all university careers and make many women leave French Higher Education and Research before securing tenure. This “drain” is explained by several factors among which motherhood holds an important place. A survey in Denmark illustrates that unlike men, one in three women abandon their scientific career after the birth of their first child. The survey I have been conducting among doctoral students and social scientists highlights the difficulties faced by women who became mothers before becoming permanent employees. Since the 1980s , recruitment requirements have become tougher with candidates needing to have written a good PhD paper, regularly have their work published , participate in scientific events and get involved in the life of research labs. Much of this work falls under hope labour , that is, unpaid work done in the hope of future employment. In this context, what could be called the myth of the “total researcher” takes shape. This is based on the double penalty of being a productive scientist (without necessarily receiving any financial reward) and embodying the ideal of a career woman, devoted companion, and dedicated mother all rolled into one. However, this ideal of the “total researcher” clashes with the actual conditions of scientific work and motherhood. Paying the motherhood penalty in academia Becoming a full-time researcher requires mothers who aren’t tenured researchers to reorganise their lives. Some cram several days’ work into one by doing casual work, part-time teaching, unpaid scientific projects, and parental responsibilities. The pace often makes women work under pressure, sometimes at the expense of the quantity and quality of their scientific work. Other women choose to remain unemployed or take parental leave and thus link their career to that of their spouse if they earn enough. If this strategy of linked career is favourable for scientific production when you have a child, it also creates material dependence that could lead to sexist and sexual violence within the family unit, which this testimony from Jeanne, a doctor and mother of a little girl, illustrates: “I sometimes feel like I have to [‘have sex’], telling myself that ‘I owe him’ and ‘He lets me know it’.” In a professional context , where every moment must count, maternity, parental or sick leave become scientific working hours in themselves. Rebecca, for example, shared that she continued writing her final thesis when her son was sent to hospital in an emergency. This situation feeds a feeling of double guilt: the respondents believe they are never up to par, neither as mothers nor as researchers. Joana explains: “I took parental leave from work, but I feel bad about working when I see my son next to me.” Some non-tenured researcher dads, on the other hand, benefit from an academic paternity bonus. The gendered division of domestic and parental tasks, as well as taking paternity leave, sometimes allows them to devote more time to their research. To quote Marion’s doctor of History husband’s words: “I have completed nearly two articles in one month of paternity leave!” The","pubDate":"Thu, 29 Oct 2026 07:58:21 +0100","titre":"The impossible equation of being a researcher mother, striving to make ends meet","url":"https://theconversation.com/the-impossible-equation-of-being-a-researcher-mother-striving-to-make-ends-meet-294312"},{"pubDate":"Thu, 29 Oct 2026 07:37:23 +0100","titre":"Photos et vidéos réalisées par des lunettes connectées : quelle place pour le consentement ?","url":"https://www.leclubdesjuristes.com/droit/photos-et-videos-realisees-par-des-lunettes-connectees-quelle-place-pour-le-consentement-18077/","id":3247524,"description":"L’actualité médiatique évoque un phénomène social qui interroge le juriste sur la place du consentement à la réalisation de photos et vidéos par des lunettes connectées : « Deux secondes suffisent. Street protests and social media strengthened Lula’s campaign amid allegations of election interference by Meta favouring Flávio Bolsonaro. Major challenges lie ahead as Lula faces a right-leaning Congress, opposition from the Bolsonaro movement and pressure from the Trump administration. Luiz Inácio Lula da Silva won Brazil’s presidential election with 51.79% of valid votes, unexpectedly reversing the first-round result won by Flávio Bolsonaro, a first in Brazilian presidential elections. Between the two rounds, he gained about 10.4 million additional votes. Defeated, right-wing challenger Flávio Bolsonaro announced that he would ask for the election to be annulled. The next day, his party, the Liberal Party (PL), acknowledged the result. Brazil’s nonalignment sounds a warning to the global far right Beyond halting the advance of Donald Trump’s and Secretary of State Marco Rubio’s influence in the region, Brazil’s election result points to strategies by which far right success in other countries can be contained. It is also a personal defeat for Trump, who invested energy and influence without openly declaring his support, but with the objective of returning the Bolsonaro family to power. Lula’s victory can be attributed to three equally important factors. The first is a package of social measures: an increase in Bolsa Família, the government’s flagship cash-transfer program; the announcement of measures benefiting individual microentrepreneurs (MEI), who account for nearly 70% of active businesses in Brazil; and, above all, the approval, during the second-round campaign, of the government’s bill reducing the working week from six to five days with no loss of pay . In a poll conducted four days before the vote, this legislation was the news item that mattered most in determining voters’ choice (17%). It was followed by reports of Supreme Federal Court (STF) justices’ involvement in the Banco Master corruption case (14%), politicians’ involvement in the same case (13%), and the Lula government’s lifting of the ban on online betting houses, known as “bets” (11%). Between the two rounds, Lula raised his government’s approval rating, particularly among higher-income voters (+6 p.p) and right-wing voters outside of bolsonarismo (+12 p.p), i.e. groups that make up Flávio’s voter base. Over the same period, fear of the Bolsonaro family’s return to power overtook fear of Lula’s reelection (44% to 42%) . Taking to the streets and digital power Such a turnaround was driven, in large part, by mass mobilisation of Lula’s supporters in the streets and on social media. Large rallies called by students and other mostly young people brought millions of people on the streets, breaking the chill seen in the preceding weeks . The largest rally in support of Lula took place in São Paulo on October 24. Demonstrators sang the Independence Anthem of Brazil, a clear reference to Brazil’s independence from Trump’s interventionist policy . Part of this interventionism was attributed to the actions of Meta, the parent company of Instagram, Facebook and WhatsApp. During the second-round campaign, allegations grew that the company had favoured Flávio Bolsonaro and other far-right candidates by manipulating its algorithms . While Meta denied any favouritism, blaming technical failures, internal messages revealed by Folha de S. Paulo revealed that Lula’s campaign had been unable to boost posts for nearly 24 hours in October. In reaction to the far right’s domination of the digital environment, one of the major landmarks of the second round was the creation of the “Lula’s Army”, a WhatsApp channel set up by a federal deputy that gathered more than 10 million","id":3244497,"source":"The Conversation – Articles (FR)","url":"https://theconversation.com/brazil-lulas-presidential-win-puts-the-brakes-on-the-rise-of-the-far-right-in-latin-america-295219","titre":"Brazil: Lula’s presidential win puts the brakes on the rise of the far right in Latin America","pubDate":"Tue, 27 Oct 2026 13:57:26 +0100"},{"pubDate":"Mon, 26 Oct 2026 13:37:46 +0100","titre":"Incendie de Limoges : mise en examen du principal suspect pour tentative de meurtre sur des policiers municipaux","url":"https://www.leclubdesjuristes.com/en-bref/incendie-de-limoges-mise-en-examen-du-principal-suspect-pour-tentative-de-meurtre-sur-des-policiers-municipaux-18055/","source":"Club des Juristes","id":3242126,"description":"Ce vendredi 23 octobre, deux suspects ont été mis en examen pour l’incendie de la mairie de Limoges et placés en détention provisoire, conformément aux réquisitions du parquet de Limoges.  Le principal suspect, 'gé de 34 ans, avait initialement été placé en garde à vue pour « destruction en bande organisée ». It originally appeared on Slaw.ca on August 16, 2022. It is republished here with permission of the author. In my professional experience working as a law librarian in multiple types of institutions, most of the time a question about or related to a situation happening in a foreign country or at the international level comes primarily through one scenario: the researcher read about it in an online media outlet, newspaper, article, blog, tweet, etc. and wants to know more. Understanding, finding relevant sources and making sense of a rapidly (d)evolving and fast moving situation in a foreign country or internationally is an incredibly complicated and labor intensive type of research, no matter how much experience you have in the subject or country. To hopefully alleviate some of the pressure on these requests from researchers, I created a monthly series, called   Through the FCIL Lens , shared in the blog of the Foreign, Comparative and International Law (FCIL) group within the American Association of Law Libraries (AALL). In this monthly series, I strive to give readers a summary with all the known and relevant information on what’s currently happening, some analysis from experts, and most importantly for the researchers, I also include at least three academic articles which help connect the situation on the ground to larger conversations and trends. I’d like to think that my purpose and hard work behind the series were confirmed a few weeks ago when the dramatic current events in Sri Lanka made international headlines in major newspapers, magazines and social media. Given my obsession and unhealthy consumption of foreign and international news,   I featured the increasingly deteriorating situation in Sri Lanka as one of the “hotspots” to observe   back in April 2022. I’m not claiming any sort of superpower, nor advocating for others to compulsively follow international news. The point is that when you are tasked with researching and finding authoritative sources in order to understand an explosive current situation in a foreign country, 97% of the time, it is not a situation coming out of nowhere. Your job is to find the relevant resources to help you link the current situation on the ground to previously documented situations, people and trends. In this post, I will mention a few crucial steps that I take in order to come up with a successful research strategy. Similarly to what I do in my legal research classes, I’m not going to enumerate a list of websites and hope the researcher finds their way. If you do that, a lot of the time, they’re left with websites which are not updated, don’t work or with a list of broken links taking you nowhere. Therefore, I will talk briefly about the initial steps I take when building a research strategy that has worked for me and also the limitations to this type of research requests that we should all be aware of. First, your main goal should be to look for specific names of people, institutions, places, perhaps a specific case or legislation. You’re aiming to find one proper name (many, if you’re lucky!) and use it as your keyword to search for sources which will help you link the current situation to previous trends, events or any relevant information. In the case of the current crisis in Sri Lanka, one of the main characters is the recently deposed president, Gotabaya Rajapaksa. If you search for his name in both free sources and subscription-based databases, you will quickly find out lots of important information. For example, he belongs to a “political dynasty” which has taken control of the country for decades and also he was hailed as a “war hero” after his leading involvement in ending the country’s civil war in 2009. Today: Finding Standards ( Susannah Tredwell, Manager of Library Services at DLA Piper (Canada) LLP , Vancouver ). It originally appeared on Slaw.ca on August 31, 2022. It is republished here with permission of the author. Standards, which “ establish accepted practices, technical requirements, and terminologies ”, are often referenced by acts and regulations; in order to be able to properly interpret a piece of legislation you may need to see the standard it is referring to. Frequently the fastest and most efficient solution (if not the cheapest) is to buy the standard, either in print or electronic format. However, if you’re buying a digital version it is important to be aware of how the standard is licenced, e.g. in some cases the person who bought the standard is the only person who can use it. For Canadian standards, the   Standards Council of Canada   (confusingly — for law librarians at least — abbreviated SCC) is a useful place to start. Standards are frequently referred to by a number (e.g. “CSA Z1008:21”) where the first letters indicate who issued the standard (in this case the   Canadian Standards Association ) , the middle numbers indicate the number of the standard, and the last number indicates the year of issue (i.e. 2021). Standards are frequently revised or replaced, so it is important to know which particular version of a standard you are looking for. Older standards can be more challenging to find. Your local public library may own some standards in print format so it is worthwhile checking with them. A number of Canadian standards are available for free; for example you can find the online collection of Codes Canada publications (including the National Building Code of Canada 2020, the National Plumbing Code of Canada 2020 and the National Fire Code of Canada 2020) at   https://nrc-publications.canada.ca/eng/search/?q=NRCCode . Today:  Secret Search tips from an Information Sleuth   by George Roy, Law Society of Manitoba (originally published February 1, 2021 on the Great LEXpectations blog): Sometimes an article can be very tricky to track down. It might be from an obscure journal, or maybe from something old enough that no one carries it any more. That may require tracking down a print version hidden away in some library’s archives, but sometimes some creative searching online can provide surprising results. Limit where you look Sometimes too much is just as bad as not enough. If you find yourself searching for an article title on a web search engine you may get hundreds or thousands of results. Most of us will scan the first page, and maybe the second, but are quick to give up after that. A lot of the time, articles will be published as a PDF, so limit your search to that file format by either using the advanced search function  Or use the limiter “filetype” in the search field. Change where you are looking Most articles are often published as part of a journal. That means you might limit your search to libraries or sites that have access to that publication. If you separate the article from the journal, you can look in unusual places that have already uploaded or published that article separate from its original publication. When you browse the search results, try looking at academic websites. Again, you can use the advanced search, or use the limiter “site:” and limit to academic domains such as “.edu.” Il apparaîtra que la question esthétique s’articule étroitement à celle du devenir de la culture.; Gilbert Simondon is known for the depth of his insights on individuation and technics, but numerous aspects of his work are still to be explored – notably his aesthetic thought. Our research aims to shed light on this dimension of simondonian philosphy, which implicitly goes through his work. The first two chapters touch upon the theory of individuation laid out in Individuation in Light of Notions of Form and Information, as well as the crucial albeit subtle role held by the concept of « aesthetism ». The third chapter looks into the place of aesthetics in the becoming of thought, described in the third part of On the Mode of Existence of Technical Objects. The fourth chapter adresses the aesthetic experience in Simondon’s psychology courses, mainly with regard to his theory of imagination and invention. Lastly, the fifth chapter attempts an explanation of the axiontological meaning of simondonian aesthetics, and of its current resonance, through the concept of techno-aesthetics. The sociologist Paolo Stuppia examines the unprecedented situation many cities across France are having to contend with, and the complex combination of collective action whose motivations are unclear and the social media’s extreme agility. The Conversation: How unprecedented are the scenes of looting that we witnessed on the sidelines of the October 17 demonstrations? Paolo Stuppia: What may be unprecedented is the extent of the destruction of private property and the goods that have been stolen. It should be clear, however, that not all the looters can necessarily be sorted into identifiable groups, at least politically. Indeed, as the politician Xavier Crettiez, the sociologist Isabelle Sommier and the historian François Audigier emphasised in 2021 in their joint project Violences politiques en France , the targets of acts of violence that are considered to be politically motivated can be determined both by technical constraints and the militant culture of the people involved. Let us recall Italy in the 1970s when autonomous activists spoke of “self-reduction” (the act of seizing goods or essential services), Maoists in France spoke of proletarian reappropriation. Their raid on Fauchon’s luxury grocery store on place de la madeleine and the redistribution of goods to slums and workers’ hostels that ensued went down in history as their biggest claim to fame. Can we go as far as to say that the October 17 looting sprees were politically motivated ? Even if we do not have all the details concerning the profiles of the people arrested, videos posted on social media and stolen goods being resold online tend to rule out the idea. That said, at least some of the targets were chosen haphazardly. While some are symbols of capitalism, like luxury stores, insurance companies, banks, multinationals , others included a number of more localised stores, small shops selling toys or video games; for example, which are rarely targets for such incidents. If, especially since the alter-globalisation movement , we have seen the emergence of damage to property, primarily targeting symbols of capitalism and multinationals, in particular; this phenomenon goes hand in hand with “off the cuff” incidents by groups without any political affiliation, who join demonstrations to “get in on the act” in such a way that we are unable to determine whether it’s just a way of letting off steam or if it’s driven by a goal of redistributing goods – this weekend we witnessed some scenes of goods being redistributed, such as food being given to the homeless. What do we know about casseurs’ profiles? When did they appear in the demonstrations and when did the term first appear in the media? P.S.: Historically, the first research article on the casseur phenomenon can be traced back to the sociologist Gwenola Ricordeau . In France in the 1990s, as was the case during the student and high school movement of 1998, Ricordeau noticed that young people came to demonstrations to commit acts of vandalism or to mug people without having anything to do with the causes behind protest movements. They were driven by opportunism and also a desire to break up the monotony of everyday life. The fact of disqualifying people by designating them as “criminals on the street” therefore ultimately leads us to riot-like phenomena, with or without the “looting” element, which are part of the continuity of “suburban revolt” or “city riots” which have gradually developed in working-class neighbourhoods since the second half of the 1970s. The i-Dressup.com website offered users – including children – a virtual way to play dress-up and design clothes without those potential dangers. But according to an FTC complaint, Unixiz, Inc. , the company behind i-Dressup, violated the Children’s Online Privacy Protection Act in ways that created different kinds of risks. COPPA puts two separate sets of protections in place to help keep parents in control of personal information collected from their kids online. First, COPPA-covered companies must clearly disclose their information policies and get parental consent before collecting personal information from children under 13. Second, companies must provide reasonable and appropriate security for the data they collect. According to an FTC settlement, i-Dressup fell short on both COPPA requirements. The complaint alleges i-Dressup failed to provide sufficient notice on its site of the information it collected online from kids, how it used it, its disclosure practices, and other specifics required by the COPPA Rule. The company’s direct notices to parents were deficient, too. Among other things, they didn’t include the COPPA-required statement that if parents don’t provide consent within a reasonable time, i-Dressup will delete their online contact information from its records. Stick with the story because that failure turned out to be particularly troubling. In addition to letting users play online games, i-Dressup featured a community where they could “explore their creativity and fashion sense with unique personal profiles” and interact with others. To register, i-Dressup required people to submit a user name, password, birthdate, and email address. If the birthdate indicated the person was under 13, the email field changed to “Parent’s Email.” Once the under-13 user filled in the required fields and clicked “Join Now,” i-Dressup collected the personal information and sent a message to the address entered into the Parent’s Email field. The person receiving the email could consent by clicking the “Activate Now!” button. However, if the parent didn’t give consent, i-Dressup retained the personal information it had collected from the child online. The FTC says the company’s failure to delete that information violated Section 312.5(c)(1) of the COPPA Rule. In addition to violating COPPA’s parental consent provisions, i-Dressup allegedly violated the Rule’s data security requirements . According to the FTC, i-Dressup stored and transmitted users’ personal information (including passwords) in plain text. In addition, the company failed to perform network vulnerability testing of its network, even for well-known threats like SQL attacks; it didn’t implement an intrusion detection and prevention system; and it didn’t monitor for potential security incidents. The upshot? The company learned that a hacker had gained entry to its network and accessed information about 2.1 million users, including approximately 245,000 users who indicated they were under 13. To settle the case , i-Dressup and its owners will pay a $35,000 civil penalty. They’re also prohibited from violating COPPA in the future, and can’t sell, share, or collect any personal information until they implement a comprehensive data security program and get independent biennial assessments. In addition, they’ll have to provide the FTC with an annual certification of compliance. The message for sites and operators covered by COPPA is that an effective system of parental consent is only the first step toward compliance. Section 312.8 of the COPPA Rule also requires you to “establish and maintain reasonable"},{"source":"FTC USA Business Blog Posts","description":"A clothes look at the RN database: Q&A with FTC staff lfair October 5, 2017 | 11:18AM A clothes look at the RN database: Q&A with FTC staff By Lesley Fair It’s not much bigger than a postage stamp, but the label on many textile, wool, and fur products provides important information, including fiber content, country of origin, and a company name or Registered Identification Number (RN). The FTC administers the RN system and industry members will want to check out recent upgrades to the RN website . With RNs and labels on our mind, we asked some common RN-related questions to attorney Josh Millard, whom we’d label as one of the FTC’s go-to people on the subject. First things first. What’s an RN? JOSH:   A Registered Identification Number (RN) is a numerical designation – the prefix RN followed by a set of digits – that identifies the company responsible for marketing, distributing or otherwise handling a product covered by the Textile, Wool, and Fur Acts.  Because some labels are small and some company names are long, the law allows U.S.-based businesses to use an RN as a “shorthand” identification. We think the upgrades to the RN website will make it even easier for businesses to use. How do I get an RN for my company? JOSH:   Apply online. FTC staff will review your application and email you typically within 1-3 business days. As soon as your application has been approved, you’ll receive your RN.  How much does it cost to get an RN? JOSH:   There’s no charge. Is it mandatory that companies use an RN on labels? JOSH:   No, you don’t have to use an RN. It’s perfectly acceptable to include your company name instead, but many companies prefer to use an RN because it takes up less space. The RN system has other benefits, too. For example, it lets people identify your business easily through the RN Search screen . Consumers or other industry members can type in the number and readily find your business. Our company doesn’t reside in the United States.  Can we get an RN? JOSH:   Only U.S.-based businesses can get an RN. If your foreign company manufactures or is involved in the advertising, distribution, or sale of a product covered by the Textile, Wool, and Fur Acts, put the company name on the label instead of an RN. Alternatively, you can label the product with the RN or business name of a U.S. company directly involved with importing, distributing, or selling the product when that’s the case. Going through our records we found we have multiple RNs.  Is that a problem? JOSH:   It’s not prohibited, but we no longer issue multiple RNs to a single company and encourage companies to cancel any extra RNs to simplify recordkeeping. Our headquarters has moved since we applied for an RN.  Do we need to update our application? JOSH:   Yes. If there has been a change to your business name, address, or legal status, please update the information in your RN registration.  An RN can be cancelled if a business doesn’t keep its information up to date, so it’s wise to check. The good news is that the upgraded RN website makes that easier to do. What if we choose to use a company name on the label, rather than an RN? JOSH:   You must include the full name your company uses to do business – in other words, the name that appears on documents like purchase orders or invoices. It can’t be a trademark, trade name, brand, or designer name unless that’s also the name under which your company does business. What kind of guidance does the FTC have for industry members? JOSH:  Threading Your Way Through the Labeling Requirements Under the Textile and Wool Acts is a great place to start, and the FTC’s Clothing and Textiles page includes links to brochures, cases, workshops and other compliance resources.","id":3201873,"titre":"A clothes look at the RN database: Q&A with FTC staff","url":"https://www.ftc.gov/business-guidance/blog/2017/10/clothes-look-rn-database-qa-ftc-staff","pubDate":"Wed, 07 Oct 2026 14:05:06 +0200"},{"id":3200011,"description":"We can’t go for that (no can do) lfair July 17, 2017 | 11:38AM We can’t go for that (no can do) By Lesley Fair Of course, phantom debt collection – the practice of pressuring people to pay “debts” they don’t owe – harms consumers. But as an FTC complaint demonstrates, when phantom debt collectors strike, they could affect your company, too. According to the FTC , a Florida-based outfit engaged in a scheme to defraud consumers through the collection of debts people didn’t actually owe or the company didn’t have the authority to collect. The complaint charges that the defendants – Hardco Holding Group, S & H Financial Group, Dequan M. Sicard, and Daryl M. Hall (no, not that Daryl Hall) – violated the FTC Act and Fair Debt Collection Practices Act. When contacting consumers, in many instances the defendants allegedly impersonated attorneys and threatened to have people thrown in jail if they didn’t pay up on delinquent payday loans – loans, remember, that many consumers didn’t take out in the first place and defendants didn’t have the right to collect. One tactic involved contacting people with a “case number” and directing them to dial a callback number. On the second call, the defendants allegedly said they were affiliated with named law firms and that the consumer had committed a felony, could go to prison, or faced arrest. According to the complaint , to boost the credibility of their threat of pending or imminent legal action, the defendants claimed to have the consumer’s Social Security number, bank account number, or contact information for family members. Afraid of legal repercussions, many consumers knuckled under to the demand for payment. The FTC says the defendants also told third parties that consumers owed money, a violation of the FDCPA. In addition, the complaint charges that the defendants didn’t disclose their identity to consumers, failed to provide proper validation notices, and used other false, misleading, and abusive tactics. Phantom debt collectors unquestionably injure consumers, but how could conduct like that affect your company? According to the lawsuit, when pressed to identify themselves, the defendants often gave the names or addresses of legitimate small businesses that had nothing to do with the purported debt or the debt collectors. When concerned consumers contacted those companies to complain, their employees got an understandably angry earful. From the FTC’s perspective, unrelated small businesses shouldn’t have their reputations sullied by others’ allegedly illegal tactics. A federal court in Orlando has temporarily halted the operation and frozen its assets. The FTC wants to stop the illegal practices once and for all. What can consumers do if they’re getting calls for debts they don’t owe ? File a complaint with the FTC. How can small businesses help protect their good names? Every now and then, do a selfie search with your company name and a word like “debt.” If you see consumer posts that suggest that a debt collector is illegally using your name – or if your employees are getting complaints about debt collection calls supposedly coming from your company – let the FTC know about it , too. In the meantime, businesses looking for FDCPA compliance resources can visit the FTC’s debt collection page for some – in the words of the other Daryl Hall (and let’s not forget John Oates) – “Adult Education.”","source":"FTC USA Business Blog Posts","pubDate":"Tue, 06 Oct 2026 14:06:39 +0200","titre":"We can’t go for that (no can do)","url":"https://www.ftc.gov/business-guidance/blog/2017/07/we-cant-go-no-can-do"},{"source":"FTC USA Business Blog Posts","id":3199071,"description":"FTC asks “Do consumers notice class action notices?” lfair September 9, 2019 | 11:17AM FTC asks “Do consumers notice class action notices?” By Lesley Fair Do consumers notice consumer class action notices? That’s one of the topics that experts will discuss at an upcoming FTC workshop on issues related to communicating with consumers about class actions . Set for October 29, 2019, in Washington, DC, Consumers and Class Action Notices: An FTC Workshop will feature panelists from a wide range of perspectives exploring what the research suggests about notice methods, claims rates, and redress – and what can be done to improve consumer participation in class action settlements. To enhance our understanding of the issues, FTC staff just released a report summarizing the findings of two studies involving consumer class actions. In the first study, we looked at a sample of more than 140 cases and analyzed how variables like notice methods and compensation amounts affected consumer claims and check-cashing rates. A second staff study explored consumer perceptions of class action notices, including whether people understood their options. Consumer class actions have been an issue of long-standing interest to the FTC. For more than a decade, the agency’s Class Action Fairness Project has worked to ensure that settlements in consumer protection and competition matters provide appropriate benefits to consumers. To that end, the FTC has coordinated with state, federal, and private groups to gather information; looked at the impact of legislative and class action rule changes; and – where appropriate – filed amicus briefs. Free and open to the public, Consumers and Class Action Notices will take place at the FTC’s Constitution Center conference facility, 400 7th Street, S.W., in Washington. Now the good news for consumers: It’s still under warranty. But where can they go to get it fixed? Can the manufacturer restrict a consumer’s ability to go to the independent repair shop of their choice? Can the manufacturer use glue, non-standard screws, and proprietary diagnostic software that make it difficult for independent repair shops to fix things? Do limitations like these affect consumers’ rights under the Magnuson-Moss Warranty Act ? That’s the topic of Nixing the Fix: A Workshop on Repair Restrictions , an FTC event scheduled for July 16, 2019 . Enforced by the FTC, the Magnuson-Moss Warranty Act helps consumers make informed buying decisions and gives them access to remedies if the widget starts to fidget during the warranty period. One key consumer protection under Mag-Moss is that the law prohibits manufacturers from conditioning warranty coverage on the use of particular products or services. Here are some of the questions FTC staff intends to ask at Nixing the Fix : What’s the interplay between repair restrictions and the Magnuson-Moss Warranty Act’s anti-tying provision, which establishes that manufacturers can’t condition coverage on the use of parts or services identified by brand, trade, or corporate name? Do repair restrictions affect the market for extended warranties and service agreements? What types of restrictions are consumers running into when they try to get their stuff repaired? Are manufacturers’ restrictions having an impact on small fix-it businesses? Are manufacturers using software that may render products obsolete or unfixable if consumers engage in DIY or go to a local repair shop? Are repair restrictions necessary to reduce the risk of physical injury or to protect manufacturers from liability for products improperly repaired by others? Do consumers understand the effects of repair restrictions? We’re also looking for empirical research and data about the prevalence and impact of manufacturers’ repair restrictions. For example, what can you tell us about code that disables products that have been repaired by someone other than the manufacturer, product designs that make third-party repairs difficult (like attaching batteries with glue only the manufacturer can remove), contractual post-sale or licensing restrictions, or proprietary diagnostic software and replacement parts? Please send us your research and data by April 30, 2019. Do you have suggestions about possible panelists? Email us at nixingthefix@ftc.gov . They agreed Creaxion would produce a “strategic media relations campaign” that would be “tied to the worldwide outbreak of the Zika Virus.” Creaxion then contacted Inside Publications, publisher of magazines like Inside Volleyball , Inside Cheerleading , and Inside Gymnastics , to broker a partnership with HealthPro. You’ll want to read the complaint for details about the “Social and Digital Media Activation and Athlete Engagement” agreement between HealthPro and Inside Publications, but here are some of the things HealthPro paid for: endorsements by leading gymnasts, magazine “articles” featuring the repellent, the product’s placement in “Good Luck” gift baskets from Inside Gymnastics to top U.S. gymnasts, and social media posts touting the product by Inside Publications and athlete endorsers. According to the complaint, Creaxion president Mark Pettit acted as an intermediary between Inside Publications and HealthPro. Ultimately, 2004 Olympic gold medal gymnast Carly Patterson Caldwell agreed to become a paid spokesperson. She received several thousand dollars for social media posts and an Inside Gymnastics advertorial. (She decided not to attend the Brazil Olympics because of her concerns about Zika.) Olympic gold medal gymnast Jake Dalton also signed on and was paid for promoting the repellent to his fans and followers. The two gymnasts posted endorsements of the repellent on social media without disclosing their paid promotional relationship. For example, Ms. Patterson Caldwell said on Facebook, “I was definitely bummed to have to make the decision to not go to Rio for the summer Olympics because of the threat of the Zika virus, but working on starting a family and being safe and protecting myself was way more important to my husband and me! I am so thankful to have found a safe and organic product (FIT Organic) that will ease my worries as mosquito season approaches.” Similarly, Mr. Dalton posted on Twitter, “Getting Rio Ready! Not worried about Zika. Fit Organic has my back and body covered. Love the Fit mosquito repellent.” Inside Publications also posted and reposted statements on social media about the repellent, primarily through its Inside Gymnastics account, including some featuring Patterson Caldwell and Dalton. According to the complaint, Inside Publications didn’t disclose the spokespersons’ paid promotional relationships with HealthPro or that its own posts were paid ads. Nor did it disclose that the “Caring for Carly,” “The latest on Zika” and “Move Over Mosquitos” articles were really paid ads. The FTC also says Creaxion conducted an online consumer review program that reimbursed Creaxion employees and “friends” for buying FIT repellent and reviewing the product online without disclosing their affiliation with the brand. Consumers who try to buy tickets online to a concert, theatrical performance, or sporting event have often expressed frustration with the process. That’s the Ticket will bring together advocates, industry members, academics, and law enforcers to explore the topic from the consumer’s perspective. FTC Commissioner Slaughter will open the event at 9:30 ET. Next on the agenda: Professor Eric Budish from the University of Chicago’s Booth School of Business, who will share his insights into the issues. The first panel will explore Bots and the BOTS Act . Passed in 2016, the Better Online Ticket Sales Act makes it illegal to “circumvent a security measure, access control system, or other technological control or measure on an Internet website or online service that is used by the ticket issuer to enforce posted event ticket purchasing limits or to maintain the integrity of posted online ticket purchasing order rules.” The next panel will address Other Consumer Protection Issues Around Ticket Availability . After a mid-day break, the topic will turn to The Adequacy of Ticket Price and Fee Disclosures . Do consumers have accurate information about how much they’ll be charged? The last panel of the afternoon will consider Consumer Confusion: What and From Whom Am I Buying? Do buyers have a clear picture of what they’re getting and the identity of the seller? Mary Engle, Director of the FTC’s Division of Advertising Practices, will offer closing remarks. Ironically enough, you don’t need a ticket to attend That’s the Ticket , which will take place on June 11th at the FTC’s Constitution Center conference facility, 400 7th Street, S.W., in Washington, DC. The event is free and open to the public or you can watch via webcast, which will go live moments before the 9:30 ET starting time on the That’s the Ticket event page. The complaint alleges the company failed to provide online shoppers with required information and tools. This is the first case brought to enforce the INFORM Act. The INFORM Act, which went into effect in 2023, seeks to make online transactions more transparent. Among other things, the law requires online marketplaces to collect, verify, and disclose certain information about high-volume third party sellers. ( Informing Businesses about the INFORM Consumers Act  has more on how the law defines terms, what’s required of online marketplaces, and the substantial penalties the FTC and state law enforcers may seek if online marketplaces violate the law.) In 2022, Temu launched its online marketplace in the United States, where consumers can view product listings on Temu’s homepage, through search results, and in gamified shopping experiences on the platform. According to the complaint, Temu violated the INFORM Act by failing to offer a mechanism for consumers to report suspicious activity — electronically and by phone — on the gamified product listings of many high-volume third party sellers and by failing to offer a telephonic mechanism on non-gamified product listings. The complaint also alleges that Temu did not post required identifying information about sellers on its gamified product listings or mobile site, and that Temu’s disclosures, when made, were difficult to find. According to the settlement, Temu will pay a $2 million civil penalty, provide a telephonic mechanism for consumers to report suspicious activity on listings, and make other required disclosures. Is your business covered by the INFORM Act? Make sure you:  Review the provisions of the INFORM Act thoroughly . Make sure you fully understand — and have measures in place to comply with — each of its requirements. Make required disclosures easy for consumers to notice . Required disclosures should stand out from any surrounding material and use plain language. Minimize or eliminate steps consumers need to take to reach required disclosures. We’ve held workshops, issued reports, and sent warning letters. If it takes sky writing, tap dancing, and a float in a Thanksgiving Day parade, we’ll do that, too. But here’s what’s not going to happen. The FTC is not giving up until businesses get the message that: 1) Free means free; and 2) Key terms and conditions have to be clearly and conspicuously disclosed. A $22 million settlement announced by the FTC and the AGs of Illinois and Ohio with a national credit monitoring service advertising so-called “free” credit scores emphasizes that point. Another note for practitioners: It's the FTC's third case alleging violations of ROSCA . One Technologies and related outfits marketed their credit monitoring programs, MyCreditHealth and ScoreSense, through at least 50 sites, including FreeScore360.com, FreeScoreOnline.com and ScoreSense.com. Their strategy was simple. Buy advertising on search engines so their ads show up near the top when people look for phrases like “free credit report\" and then follow up with a persuasive pitch: “View your latest Credit Scores from All 3 Bureaus in 60 seconds for $0!” According to the lawsuit , the defendants failed to clearly tell consumers that if they availed themselves of those “free” services and didn’t cancel within seven days, the defendants would ding their credit cards for $29.95 a month over and over and over again. The complaint includes screen shots of the defendants’ sites, but before looking at them, take out your reading glasses because they’ll come in handy in trying to locate where the defendants chose to tell people about that $29.95 monthly fee. One line of fine print added in late 2012 said “Free 7-Day trial when you order your 3 Free Credit Scores. Membership is then just $29.95 per month until you call to cancel.” The first problem: The type was tiny – a fraction of the size of the defendants’ multiple use of the word “free.” The second problem: Why should consumers even have to be on the look-out for the cost, given that the defendants so prominently advertised it as “free”? A second purported disclosure appeared as an obscure hyperlink on the page where people typed in their Social Security number and birthdate.  Sandwiched between the logos of various security firms and a large color button that said CONTINUE was this less-than-crystal-clear statement: By clicking on the ‘Continue’ button, you agree to the Offer Details, to the Terms and Conditions, acknowledge receipt of our Privacy Policy and agree to its terms . . . The “Offer Details” link triggered a small pop-up that said, among other things, “At the end of the 7-day trial period, your credit/debit card will be charged $29.95 on a monthly basis until you call to cancel.” Another place the defendants put the information was on a side panel of the Payment Form in white letters on a grey background – a color combination one of the defendants’ own employees described as “known to cause seizures in lab rats.” According to the complaint, once people spotted the unauthorized charges on their accounts, the defendants didn’t make it easy to stop the billing.  And even when people asked for their money back because they hadn’t approved of the charges, the defendants denied refunds to many of them. The lawsuit alleges violations of the FTC Act, as well as the Illinois Consumer Fraud Act, the Ohio Consumer Sales Practices Act, and related state rules. In addition, the complaint is the third FTC action to charge violations of ROSCA, the Restore Online Shoppers’","id":3194913,"source":"FTC USA Business Blog Posts","url":"https://www.ftc.gov/business-guidance/blog/2014/11/company-pay-22-million-offering-free-credit-scores-turned-out-be-not-so-free","titre":"Company to pay $22 million for offering \"free\" credit scores that turned out to be not so free","pubDate":"Sat, 03 Oct 2026 08:09:37 +0200"},{"description":"Le CMIT, club des marketeurs de l’IT, fait de son forum parisien le lieu où redéfinir le métier de marketeur, face à une IA qui produit désormais une part du contenu. They battle specific opponents through a feature known as the Nemesis System. In the FTC’s lawsuit against Warner Bros. Home Entertainment , truth in advertising had a nemesis: paid pitches for Shadow of Mordor that Warner Bros. deceptively claimed were independent reviews. And read on for a startlingly candid statement by one of those influencers. To help launch Shadow of Mordor , Warner Bros. brought a social media company on board to coordinate a YouTube influencer campaign. One strategy was to hire influential gamers to post videos promoting Shadow of Mordor – videos that ultimately yielded more than 5.5 million YouTube views. In addition to free game access, Warner Bros. paid the influencers cash – ranging from hundreds of dollars to five figures. Influencers’ videos were subject to pre-approval and, according to the terms of the agreement, Warner Bros. “will be deemed the author and exclusive owner.” Warner Bros. was quite exacting in what else it required of influencers: “Video will feature gameplay” of the Shadow of Mordor game. “Video will have a strong verbal call-to-action to click the link in the description box for the viewer to go to the [game’s] website to learn more about the [game], to learn how they can register, and to learn how to play the game.” “Video will promote positive sentiment” about the game. “Video will not show bugs or glitches that may exist.” “Video will not communicate negative sentiment” about Warner Bros. Home Entertainment, its affiliates or the game. Warner Bros. also required “One Facebook post or one Tweet by Influencer in support of Video.” “Positive sentiment” posted for cash? That sounds like the kind of material connection between an advertiser and endorser the FTC says should be clearly and conspicuously disclosed. And for FTC watchers, that’s where the story gets almost as interesting as Shadow of Mordor . According to the complaint , influencers were directed to place sponsorship information in the text of the description box – that’s the collapsed box just below a YouTube video – not in the video itself. Furthermore, they were told to put “information about [the game] above the fold” in the description box and that the “description box will include FTC disclaimer disclosing that the post is sponsored.” But as the first example shows, only the top few lines of the description box are immediately visible. Without clicking the “Show More” button and possibly scrolling down, consumers wouldn’t see the sponsorship disclosure – especially since Warner Bros. mandated that game information had to come first. The second screenshot shows an example of the sponsorship information at the end of the expanded “Show More” box and illustrates – inadvertently perhaps – the FTC’s concern with the placement of the disclosure. In this example, the gamer wrote “This video sponsored by Warner Bros.” and followed with this telling statement: “No one reads this far into the description ... what are you doing snooping around.” Our sentiments exactly, Dude. In other instances, influencers’ videos included a half-hearted sponsorship disclosure – for example, “This has been one of my favorite sponsored games, so thanks that I could play it for free!!” – that failed to mention that in addition to free play, Warner Bros. was paying them thousands of dollars. The complaint charges that Warner Bros. falsely represented that the Shadow of Mordor gameplay videos reflected the independent opinions or experiences of impartial","id":3189423,"source":"FTC USA Business Blog Posts","url":"https://www.ftc.gov/business-guidance/blog/2016/07/ftc-challenges-influencer-campaign-warner-bros-shadow-mordor-game","titre":"FTC challenges influencer campaign for Warner Bros.’ Shadow of Mordor game","pubDate":"Thu, 01 Oct 2026 08:11:55 +0200"},{"url":"https://www.ftc.gov/news-events/news/press-releases/2026/09/ftc-seeks-public-comment-whether-update-rule-impersonation-government-businesses-address-platforms","titre":"FTC Seeks Public Comment on Whether to Update Rule on Impersonation of Government and Businesses to Address Platforms’ Role in Promoting Impersonation Scams","pubDate":"Fri, 25 Sep 2026 08:10:48 +0200","description":"The Federal Trade Commission announced today that is considering whether to update its Rule on Impersonation of Government and Businesses or take other action to prevent online platforms from engaging in ad-optimization practices that may be furthering impersonation scams. In an Advance Notice of Proposed Rulemaking (ANPRM) to be published in the Federal Register , the FTC is seeking comment on the extent to which ad-optimization tools and services offered by social media, search engines and other digital marketplace platforms further efforts by scammers to impersonate legitimate businesses and government agencies using online ads.  “Free markets depend on trust, transparency and consumers’ ability to make informed choices. Impersonation scams—especially when amplified by digital platforms that profit from them—do more than rob Americans of their hard-earned money,” said Christopher Mufarrige, Director of the FTC’s Bureau of Consumer Protection. “They erode the very foundation that allows competitive markets to function. Today’s impersonation scams are no longer the work of isolated con artists; they are sophisticated, highly engineered operations powered by the same advertising and targeting tools that platforms sell to legitimate businesses. Consumers reported nearly $3.5 billion in losses to impersonation fraud last year, and the true cost is likely far higher. “The Commission’s mission has always been to safeguard the conditions under which competitive markets can thrive. Increasingly, consumers rely on a small number of dominant digital platforms for everyday transactions—from shopping, banking and travel bookings to accessing government services. Yet these platforms are the very places fraudsters seek out consumers, exploiting their trust while platforms profit from optimizing and disseminating scam ads. “Today’s advance notice of proposed rulemaking asks whether the Commission should require platforms to take concrete steps to prevent impersonation ads from ever reaching consumers. By exploring potential new obligations platforms would have to follow, the rulemaking aims to ensure that Americans participate in an online economy where truthful information guides consumer choice.”  Impersonation scams have topped the list of fraud complaints reported to the FTC by consumers in recent years. In 2025, the FTC received more than 1 million reports about imposter scams from consumers, who reported losing nearly $3.5 billion to such scams. In addition, online platforms play an important role in many scams. For example, nearly 30% of consumers who reported losing money to scammers in 2025 said they were first contacted on social media platforms, with reported losses reaching $2.1 billion. The ANPRM notes that impersonation scams have been amplified by search engines, social media and other digital marketplace platforms that profit from optimizing online ads for third parties, regardless of whether the third parties are legitimate. The ANPRM seeks comment on a wide range of topics related to the use of these ad-optimization tools and services and the proliferation of ads that impersonate businesses and government agencies including:  The financial incentives driving these platforms to offer ad-optimization tools and services, details on how each tool and service optimizes the content and delivery of the ad, and the steps platforms currently take to prevent the use of such tools and services for deceptive advertising The extent to which these platform ad-optimization tools and services constitute unfair or deceptive acts or practices by furthering impersonation scams Whether these unfair or deceptive acts or practices are prevalent in the marketplace and whether the Commission should address these acts or practices by amending the existing Impersonation Rule, proposing a new separate rule or implementing non-regulatory Measures Measures the Commission could consider in crafting any new regulations, including vetting","id":3176041,"source":"Federal Trade Commission - Protecting America's Consumers"},{"id":3170741,"description":"One of the recurring themes of this column has been the extent to which the governance of artificial intelligence in Canada is increasingly being shaped by institutions outside the country while regulatory action within the country is largely stalled. Also taking part in the event were William Cockburn , Executive Director of EU-OSHA; Mikel Torres , Deputy First Minister and Minister of Economy, Labour and Employment of the Basque Government; Ainara Basurko , Provincial Councillor for Economic Promotion and First Deputy General; and Amaia Arregi , First Deputy Mayor and Counsellor for Security at the Bilbao City Council. During the inauguration, European Commission Executive Vice-President Roxana Mînzatu highlighted that EU-OSHA’s new headquarters in the BAT marks the beginning of a new chapter for the Agency, which has been based in Bilbao since 1996 and has become Europe’s reference point for occupational safety and health. She noted that the building symbolises values such as innovation, sustainability and openness to the future, which define both EU-OSHA and the European project. Mînzatu underlined that the rapid changes taking place in the world of work create opportunities but also new risks, and stressed the importance of prevention, evidence-based policies and cooperation among institutions, businesses, researchers and workers. She also highlighted EU-OSHA’s role in identifying emerging risks and promoting good practices, recalling that occupational safety and health should be viewed as an investment in people and in Europe’s competitiveness. The Executive Vice-President further stated that the Agency’s new headquarters reflect a competitive and socially responsible Europe, capable of combining innovation, economic growth and the protection of people. Finally, she thanked the European, Spanish, Basque and local authorities for their support and acknowledged the contribution of EU-OSHA staff to creating safer and healthier workplaces across Europe. The complaint   alleges that, for over seven years, Amazon has covertly and substantially increased the prices that more than one million brands and sellers were required to pay to advertise on its platform. As a result, the complaint alleges that Amazon’s scheme has likely extracted tens of billions of dollars from its unwitting advertising customers. “When one of the world’s largest online retailers engages in unfair and deceptive conduct, the impact can be staggering,” said Chairman Andrew N. Ferguson. “Amazon has millions of advertising customers who were misled into paying significantly higher prices. These higher costs were largely passed on to American consumers. The FTC under President Trump won’t allow this deception to continue.” The FTC, along with the attorneys general of Alaska, Arizona, California, Colorado, Florida, Idaho, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maryland, Nebraska, New Jersey, New York, North Carolina, Oklahoma, Pennsylvania, Rhode Island, South Carolina, Vermont and Washington, allege Amazon has imposed undisclosed surcharges on its advertising customers, which include over 500,000 small- and medium-sized businesses that participated in auctions for advertising placements on Amazon.com and its mobile app. In these auctions, prospective advertisers bid to place Sponsored Product ads, Sponsored Brands ads and Display Ads alongside the results that appear when a consumer searches for a product using a keyword on Amazon’s store. Placements are auctioned to the highest-ranked bidder for each keyword. As described in the complaint, Amazon has represented to prospective advertisers for years that Amazon runs “second price” auctions where the winner of the auction would only pay “one cent more than the next highest bidder” for each successful bid for an advertising keyword. However, in practice, the complaint alleges that Amazon has charged its Sponsored Products advertisers their own winning bid close to 80% of the time and has effectively converted its nominally “second price” auction into a first price auction. According to the complaint, Amazon’s “second price” auctions have been described by Amazon, and understood by advertisers, to be run as generalized second-price, or GSP auctions, which have been the accepted industry standard for digital advertising placements. The complaint states that Amazon has made these or similar representations on its website, in training videos and in other public-facing materials, as well as in presentations made to advertisers by its hundreds of sales personnel.  The type of auction matters to advertisers because it impacts how they bid. In a sealed first-price auction—the type of auction where winners pay the amount of their winning bid—bidders run the risk that they might overbid. So, in repetitive auctions for the same goods, they will often reduce their bid to determine what the minimum amount needed to win future auctions might be. This is called bid shading. In second-price auctions, bidders are more likely to bid higher, closer to their true value for the product, because they will only be liable to pay the least bid amount needed to win under the auction’s rules.  As alleged in the complaint, Amazon told advertisers it ran a GSP, but for years its auction pricing had “a surcharge hidden in it,” in the words of one internal Amazon document. The complaint alleges that, beginning in 2019, Amazon changed its auction rules without notice by adding an undisclosed surcharge that Amazon referred to internally as a “soft reserve price.” This resulted in advertisers paying substantially more than the price determined by the GSP auction.  According to the complaint, Amazon","id":3127461,"source":"Federal Trade Commission - Protecting America's Consumers"},{"titre":"Where Are the Law Librarians?","url":"https://www.slaw.ca/2026/08/27/where-are-the-law-librarians/","pubDate":"Fri, 28 Aug 2026 07:58:57 +0200","description":"In recent years, the number of law librarians in public sector and academic roles has declined.
