But the term, which comes from the French verb casser or “to break”, poses more questions than answers. The sociologist Paolo Stuppia examines the unprecedented situation many cities across France are having to contend with, and the complex combination of collective action whose motivations are unclear and the social media’s extreme agility. The Conversation: How unprecedented are the scenes of looting that we witnessed on the sidelines of the October 17 demonstrations? Paolo Stuppia: What may be unprecedented is the extent of the destruction of private property and the goods that have been stolen. It should be clear, however, that not all the looters can necessarily be sorted into identifiable groups, at least politically. Indeed, as the politician Xavier Crettiez, the sociologist Isabelle Sommier and the historian François Audigier emphasised in 2021 in their joint project Violences politiques en France , the targets of acts of violence that are considered to be politically motivated can be determined both by technical constraints and the militant culture of the people involved. Let us recall Italy in the 1970s when autonomous activists spoke of “self-reduction” (the act of seizing goods or essential services), Maoists in France spoke of proletarian reappropriation. Their raid on Fauchon’s luxury grocery store on place de la madeleine and the redistribution of goods to slums and workers’ hostels that ensued went down in history as their biggest claim to fame. Can we go as far as to say that the October 17 looting sprees were politically motivated ? Even if we do not have all the details concerning the profiles of the people arrested, videos posted on social media and stolen goods being resold online tend to rule out the idea. That said, at least some of the targets were chosen haphazardly. While some are symbols of capitalism, like luxury stores, insurance companies, banks, multinationals , others included a number of more localised stores, small shops selling toys or video games; for example, which are rarely targets for such incidents. If, especially since the alter-globalisation movement , we have seen the emergence of damage to property, primarily targeting symbols of capitalism and multinationals, in particular; this phenomenon goes hand in hand with “off the cuff” incidents by groups without any political affiliation, who join demonstrations to “get in on the act” in such a way that we are unable to determine whether it’s just a way of letting off steam or if it’s driven by a goal of redistributing goods – this weekend we witnessed some scenes of goods being redistributed, such as food being given to the homeless. What do we know about casseurs’ profiles? When did they appear in the demonstrations and when did the term first appear in the media? P.S.: Historically, the first research article on the casseur phenomenon can be traced back to the sociologist Gwenola Ricordeau . In France in the 1990s, as was the case during the student and high school movement of 1998, Ricordeau noticed that young people came to demonstrations to commit acts of vandalism or to mug people without having anything to do with the causes behind protest movements. They were driven by opportunism and also a desire to break up the monotony of everyday life. The fact of disqualifying people by designating them as “criminals on the street” therefore ultimately leads us to riot-like phenomena, with or without the “looting” element, which are part of the continuity of “suburban revolt” or “city riots” which have gradually developed in working-class neighbourhoods since the second half of the 1970s. This research examines how Inuit experts understand and explain the marked overrepresentation of Inuit in Quebec’s correctional system. More specifically, it focuses on the arguments they construct, the knowledge they draw on, and variations in their perspectives according to their trajectories and professional positions. Seven Inuit experts from community, political, judicial, academic, and correctional fields participated in qualitative semi-structured interviews. The analysis of the interviews reveals two main explanatory registers. The first situates overrepresentation within the transformations associated with colonialism and the contemporary social, family, and community realities of Nunavik that are linked to them. The second focuses on the functioning of police, judicial, and correctional institutions and their role in Inuit trajectories of criminal justice involvement and incarceration. The experts also draw on Inuit conceptions, practices, and knowledge to highlight certain limitations of institutional responses. The findings show that a distinct Inuit specificity clearly emerges from the experts’ arguments, without relying primarily on comparisons with other Indigenous peoples. Despite the diversity of their trajectories, the experts offer largely convergent explanations and develop an overarching view of overrepresentation in which historical, social, and institutional dimensions are closely interconnected. Finally, their expertise is built from closely intertwined professional, personal, family, and community experiences, inviting a reconsideration of the boundaries of expertise. dc.type: Thèse ou mémoire / Thesis or Dissertation etd.degree.discipline:","id":3217997},{"titre":"Andrew Mountbatten-Windsor -v- The Central Criminal Court and another","url":"https://www.judiciary.uk/judgments/andrew-mountbatten-windsor-v-the-central-criminal-court-and-another/","pubDate":"Fri, 09 Oct 2026 08:11:44 +0200","description":"Claim No. AC 2026-LON-002321 In the High Court of Justice King’s Bench Division Administrative Court 8 October 2026 Before: The Honourable Mr Justice Hilliard Between: The King on the application of Andrew Mountbatten-Windsor -v- (1) The Central Criminal Court (2) The Chief Constable of Thames Valley Police The post Andrew Mountbatten-Windsor -v- The Central Criminal Court and another appeared first on Courts and Tribunals Judiciary","id":3205983,"source":"Judgement Courts Tribunals England Wales"},{"id":3198181,"description":"Keep FCRA in the foreground when the subject is background screening chundycz April 9, 2014 | 12:13AM Keep FCRA in the foreground when the subject is background screening By Lesley Fair When the talk turns to Big Data, part of the conversation is about all the public information available about people's lives – and how companies market it to prospective employers, landlords, etc.  Two cases just announced by the FTC  serve as a cautionary reminder to members of the industry that what they do may be subject to the long-standing consumer protections of the  Fair Credit Reporting Act (FCRA) .  InfoTrack, an Illinois company, and San Diego-based Instant Checkmate will be paying civil penalties to settle FTC lawsuits that they violated the FCRA.  Is it time for an FCRA refresher at your business? Instant Checkmate marketed its reports as a way for prospective employers and landlords to investigate applicants.  For example, the company advertised that one of the “GOOD REASONS to get instant criminal checks on anyone right now” was to “check out tenants before they rent.”  It also used a Google Ad Words campaign to make sure its site appeared when people searched for background checks on nannies, babysitters, maids, and housekeepers.  What kind of information would buyers get?  Current and previous addresses, birth certificates, arrest histories, and marriage and divorce records, to name just a few examples. InfoTrack offered similar services to employers nationwide, including background screening reports with people’s driving records, education and employment information, criminal histories, and even records from sex offender registries. How does the FCRA come in?  The law defines a “consumer report” as a “communication of any information” by a consumer reporting agency (CRA) that bears on a person’s “credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living” which is used (or expected to be used) as a factor in establishing their eligibility for credit, insurance, employment, or other reasons outlined in the law. According to the FTC, what Instant Checkmate and InfoTrack were doing triggered the FCRA.  For example, companies covered by the law must follow procedures to assure their reports are as accurate as possible, must take steps to see that those using their reports have permissible purposes for accessing them, and must provide required User Notices explaining key protections for consumers.  The law imposes special requirements when CRAs provide reports containing public record information that could have an adverse effect on a person’s ability to get a job.  In that case, the CRA must either: 1) notify the consumer that it’s reporting the information in the public record; or 2) maintain “strict procedures” – that’s the language in the law – designed to ensure the reported public information is complete and up to date. You’ll want to read the complaints for specifics of where the FTC says the companies fell short, but one example cited in the lawsuit against InfoTrack offers an object lesson on why FCRA protections are so important to consumers – and how the consequences can be devastating when companies don’t live up to the law.  According to the FTC, the reports InfoTrack provided to prospective employers included information about whether a job applicant was on the National Sex Offender Registry.  The employer would provide the first and last name and the date of birth to help InfoTrack with its search.  The problem was that before the fall of 2011, no date of birth was available for many names on the Registry.  If InfoTrack’s search found more than one person with the same first and last name, it reported a “possible match” to employers and gave them reports that included several different people with the","source":"FTC USA Business Blog Posts","pubDate":"Mon, 05 Oct 2026 14:07:46 +0200","titre":"Keep FCRA in the foreground when the subject is background screening","url":"https://www.ftc.gov/business-guidance/blog/2014/04/keep-fcra-foreground-when-subject-background-screening"},{"pubDate":"Mon, 05 Oct 2026 07:58:12 +0200","titre":"Summaries Sunday: Supreme One-Liners","url":"https://www.slaw.ca/2026/10/04/summaries-sunday-supreme-one-liners-49/","id":3197232,"description":"As a supplement to our Sunday Summary each month, Supreme Advocacy LLP in Ottawa presents Supreme One-Liners, a super-short descriptive guide to the most recent decisions at the Supreme Court of Canada. Plea bargains make up the vast majority of criminal convictions, and defendants routinely trade their rights — to indictment, to remain silent, to an attorney, to a jury — in exchange for a faster trial or a lesser charge. The modern criminal legal system is a regime of negotiated justice. Rights used to have more force. On the one hand, actors and paths of knowledge transfer are described. It is shown that two phases with different emphases of reception must be distinguished, namely a first phase from the 1830s to the 1850s and a second phase around the turn of the 20 th","id":2117183,"source":"Clio@Themis","titre":"Atlantic Knowledge Transfer. Recent discussions have focused on doctrinal issues such as what type of force is considered “reasonable” under the Fourth Amendment and the propriety of qualified immunity as a defense that can shield law enforcement from civil litigation. However, there has been little commentary on how these and other legal questions might be informed by medicine — specifically, victim diagnoses that might effectively absolve officers from criminal prosecution or civil liability. Yet, this is not the first crisis in this system. Against threats to international peace and security, strategies for empowering, delegating and adapting powers have been developed. The notion of the “emergency” of the reaction acts as a driving force for the empowerment and the gradation of institutional powers, but also for their delegation to other bodies or subjects of international law. These systemic adaptations of the structure of the maintenance of international peace and security through the notion of emergency reveal its finalistic nature: emergency makes it possible to achieve the goal of maintaining peace and security by influencing the assessment of an act’s conformity with international","source":"Sorbonne Student Law Review - Revue juridique des étudiants de la Sorbonne"}]
