Dear CALLeagues, I hope this finds you well and enjoying the first stretch of summer. Our formal post-conference survey has now been released, and I encourage every member to take a few minutes to complete it. If you joined us in Moncton, please tell us what worked, what did not, and what you would like to see from future CALL/ACBD conferences. If you were not able to attend, we want to hear from you as well. This survey is about more than feedback on one event. It will help us understand who is coming to our conferences, why they attend, what they value, and what barriers may be keeping others away. We also want to know what might make attendance easier or more compelling in future years. Your answers will help us improve next year’s conference in Saskatoon and plan more thoughtfully for the years ahead. On that note, I am very excited to share some big news: CALL/ACBD will be heading to Toronto in 2028 to celebrate the Association’s 65th anniversary! Sixty-five years is a remarkable milestone, representing decades of leadership, collegiality, advocacy, scholarship, and service by law librarians and legal information professionals across Canada. To encourage survey participation, we will be holding two draws for respondents. You may choose to enter one draw or both. The first draw is for a one-night stay in a Delta room at the Delta Beauséjour in Moncton. The second draw is for $100 off registration for the 2027 CALL/ACBD conference in Saskatoon. Please complete the survey and help shape what comes next for CALL/ACBD. Wishing you all a relaxing and restorative summer, filled with wonderful moments. Some of the changes include moving the general rules to their own section and revising rules on citing regularly updated books, regulations, administrative decisions, and generative AI for greater clarity and increased consistency across the guide. Additions to the guide include guidance on creating a bibliography/table of authorities and on citing reports, dissertations, municipal by-laws, court materials, First Nations, Métis, and Inuit - Crown Treaties, amongst other sources. A more detailed list is in the guide’s introduction. Since the publication of the guide in June 2024, the editors have led multiple online training sessions and conference workshops. We are now working on training materials that reflect the revised edition. The francophone editors continue to work on the French version of the guide, with the aim to publish it in 2026. Once the French version is published, we will be able to better focus our efforts to have the courts, tribunals, and the government adopt the guide and to add the guide to citation management tools. Prior to this, I worked on two certificate programs through the British Columbia Institute of Technology (Office Administrator with Technology and Medical Office Assisting). I worked as a registration and health records clerk for a few years in the hospitals. Managing patient records introduced me to the processes of information preservation and confidentiality which in turn piqued my interest in legislation pertaining to freedom of information. I've also had some personal experiences which have lead to my overall interest in examining opportunities in the legal industry. I generally find knowing more about my rights is empowering and being surrounded professionally in an industry that serves those who advocate and rally for rights is something I am excited to contribute to. 2.       How has being involved in CALL helped you professionally (e.g. scholarships & grants, continuing education, networking)? I joined CALL in January 2020 so I am definitely still green, but I've found the professional development opportunities and connecting with other members to be incredibly supportive and educational. There are many opportunities here in the association to be a part of and to contribute to. I have really enjoyed being paired up as a mentee in the mentorship program as it has provided me in gaining more insight and perspective on the industry and provides opportunity for professional rapport. Being the Members and Projects Profiles Coordinator has been more challenging than I anticipated and meeting deadlines might be something to work on...In saying that, it has been great to learn and connect a bit more with our members where I otherwise may not have!   3.       What was your first library-related job? Not a job, but I was part of a volunteer program in 2004 to 2005 called Katimavik where people ages 18 to 23 would live with each other and volunteer in the community across three provinces. I had two library volunteer rotations: Bibliothèque Publique De Tracadie-Sheila in Tracadie-Shelia, New Brunswick and the Jasper Municipal Library in Jasper, Alberta. I enjoyed putting the books back on the shelves and seeing what people were reading. I also learned some basic library protocols such as processing materials to send to other branches, checking materials out to clients, and minor repairs. I also worked with a great team at Indigo Books in morning operations from 2018 to 2020. I've been in my role as a library assistant with CLBC for a little over a year which has provided much learning experience in processing and cataloging legal materials and professional development examining important topics including but not limited to, systemic racism, understanding trauma, Indigenous human rights, etc.           4.    What’s one blog, website, or Twitter account that you can’t go one day without checking?     As an information junkie, it is difficult to pick one. But as a case just announced by the FTC demonstrates, that’s not the only kind of false government affiliation that can deceive consumers. A $2.2 million settlement with American Immigration Center reminds other businesses of the dangers of conveying a misleading connection to a government agency. When consumers wanted to renew their green cards or apply for naturalization, where did they go? Online, of course, where they input terms like “USCIS,” “INS,” or “US Immigration” to search for the proper government site. According to the FTC, that’s how they ran across results with tag lines like “USCIS Forms – Easy Online Forms for Green Card & Citizenship.” A click took them to sites with the outward appearance of official government webpages. First, there were the URLs – usimmigration.us, uscitizenship.info, etc. Then there was the red, white, and blue color scheme, the Statue of Liberty, passports, and pictures of then-President Obama. What’s more, people looking for, say, Green Card Renewal Form I-90, saw links with the exact name of the relevant document. According to the FTC, people paid between $120 to $300 and input a substantial amount of personal information, all under the impression they were filing documents directly with a government agency. Except that they weren’t. Despite the appearance of those pages, consumers were actually on one of many commercial sites the defendants used to sell their “software wizard” to fill out government immigration forms. And the money consumers paid didn’t go toward government filing fees. It went straight into the defendants’ pockets. In addition to the $2.2 million judgment, the defendants have agreed to clearly disclose that: 1) their sites aren’t affiliated with the government; 2) people must separately file immigration applications with the appropriate government agency; and 3) people must separately pay applicable filing fees to the government. The proposed order also bars the defendants – principal Cesare Alessandrini and Forms Direct, Inc., doing business as American Immigration Center – from stating or implying any affiliation with the government. What’s the message for other companies? Avoid an affiliation conflation. Look at your ads and websites from the point of view of your target audience. Could prospective customers be left with the misimpression that your company has an affiliation with a government agency? Steer clear of any purported connection to a local, state, or federal government office. Consider the big picture. The complaint in this case cited the words the defendants used to convey claims to consumers, as well as what their websites looked like. That’s because, according to the FTC Deception Policy Statement , “The Commission will evaluate the entire advertisement, transaction, or course of dealing in determining how reasonable consumers are likely to respond.” That specifically includes visual imagery and the omission of material information. Wise companies bear in mind the FTC’s long-established “net impression” standard and exercise caution in drafting their copy, selecting graphics, and choosing what they say – and what they don’t say – to consumers.","id":3203252,"titre":"FTC sues American Immigration Center for claiming false government affiliation","url":"https://www.ftc.gov/business-guidance/blog/2018/10/ftc-sues-american-immigration-center-claiming-false-government-affiliation","pubDate":"Thu, 08 Oct 2026 08:06:59 +0200"},{"description":"First INFORM Consumers Act enforcement case filed against online marketplace Temu kkrown September 5, 2025 | 10:00AM First INFORM Consumers Act enforcement case filed against online marketplace Temu Online marketplaces and third party sellers looking for a refresher on the INFORM Consumers Act should look no further than the recent settlement with Whaleco, Inc., which operates the online marketplace Temu. The complaint alleges the company failed to provide online shoppers with required information and tools. This is the first case brought to enforce the INFORM Act. The INFORM Act, which went into effect in 2023, seeks to make online transactions more transparent. Among other things, the law requires online marketplaces to collect, verify, and disclose certain information about high-volume third party sellers. ( Informing Businesses about the INFORM Consumers Act  has more on how the law defines terms, what’s required of online marketplaces, and the substantial penalties the FTC and state law enforcers may seek if online marketplaces violate the law.) In 2022, Temu launched its online marketplace in the United States, where consumers can view product listings on Temu’s homepage, through search results, and in gamified shopping experiences on the platform. According to the complaint, Temu violated the INFORM Act by failing to offer a mechanism for consumers to report suspicious activity — electronically and by phone — on the gamified product listings of many high-volume third party sellers and by failing to offer a telephonic mechanism on non-gamified product listings. The complaint also alleges that Temu did not post required identifying information about sellers on its gamified product listings or mobile site, and that Temu’s disclosures, when made, were difficult to find. According to the settlement, Temu will pay a $2 million civil penalty, provide a telephonic mechanism for consumers to report suspicious activity on listings, and make other required disclosures. Is your business covered by the INFORM Act? Make sure you:  Review the provisions of the INFORM Act thoroughly . Make sure you fully understand — and have measures in place to comply with — each of its requirements. Make required disclosures easy for consumers to notice . Required disclosures should stand out from any surrounding material and use plain language. Minimize or eliminate steps consumers need to take to reach required disclosures. Ensure required disclosures are available across all iterations of your platform . The INFORM Act mandates disclosures on all interfaces with product listings. And as your platforms evolve, regularly assess and update your compliance efforts. If your business sells through online platforms, check out  What Third Party Sellers Need to Know About the INFORM Consumers Act . This covers what sellers are impacted by the INFORM Act, what you can expect online platforms to require of you, and what information platforms must disclose about you to consumers. However, certain trends could be linked to the emergence of AI. The first rounds of redundancies attributable to AI are mainly in the most exposed industries (finance and IT), although AI adoption is sometimes used as a cover for other reasons for redundancies. Furthermore, there appears to be a slowdown in the employment of young workers. During previous technological revolutions, the jobs created by new technologies offset those lost, and the nature of work was deeply transformed. In light of this, public policy measures must provide support, particularly in the area of training, to workers so they can retrain when their jobs are put at risk by AI, and foster AI's diffusion across the economy. At the BEREC public debriefing on 10 June, the BEREC Chair, Marko Mismas (AKOS, Slovenia), and the Working Group Co-Chairs presented BEREC’s assessment of the DNA proposal, outlining key regulatory considerations that emerged from its analysis. BEREC welcomes the ambition of modernising the EU connectivity framework and supporting resilient, sustainable and high-quality digital networks. At the same time, the assessment highlights areas where further refinement may be needed to ensure that the future framework strengthens rather than adds unnecessary complexity to the internal market for electronic communications. BEREC has developed thematic papers examining key elements of the proposal in greater depth, supporting evidence-based input to the co-legislators. To further contribute to the policy debate, BEREC will publish three additional thematic papers by the end of June. BEREC remains committed to providing its technical and regulatory expertise to help shape a competitive, innovative and future-proof digital Europe. 5G slicing guidance BEREC experts look forward to receiving stakeholders’ input to the public consultation on the draft further guidance on 5G network slicing by 6 August 2026. The draft guidance aims to provide greater regulatory certainty for market players and support innovation in 5G services, while safeguarding open internet principles. Building on the existing Open Internet framework, the guidance will assist providers in assessing whether network slicing-based services comply with the Regulation, including in relation to internet access and specialised services. Reflecting the principle of technological neutrality, the approach is intended to remain relevant beyond 5G and to apply to other technologies that use comparable quality-of-service mechanisms. Call for inputs on roaming BEREC has issued a call for inputs regarding its work on roaming. This call aims to support the preparation of BEREC’s Opinion for the European Commission on the upcoming review of the EU Roaming Regulation and the Implementing Regulation on Fair Use Policy and Sustainability, which is scheduled for submission by the first quarter of 2027. Building on its 2025 Opinion, BEREC invites stakeholders to provide new information, evidence, and perspectives by 21 August 2026. In addition, following the consultation on possible amendments to the BEREC Roaming Benchmark Data Collection procedure, BEREC decided to maintain the current quarterly data collection approach. However, the expansion of the Roam-Like-at-Home regime to Ukraine and Moldova on 1 January 2026, together with the simplification proposals in BEREC’s 2025 Opinion on the Roaming Regulation, requires an update of the roaming data collection template. BEREC therefore launched a call for input on the revised template and invites operators to submit their comments by 3 July 2026. Emergency communications resilience Ensuring uninterrupted access to emergency services for end users remains a critical priority as 2G and 3G mobile networks are progressively phased out across Europe. During its latest plenary meeting, the Heads of the European regulators for electronic communications discussed and adopted a BEREC statement addressing concerns that some devices may fail to connect to emergency communications services, including 112, once legacy networks are switched off. The statement aims to raise awareness of the issue and calls for closer cooperation across the entire communications ecosystem. The virtual chief information security officer (vCISO) has become essential for organizations seeking to enhance their cybersecurity resilience while managing costs effectively. Effective security leadership is more crucial than ever, particularly in light of the evolving threat landscape, which includes ransomware attacks and data breaches. Addressing Cybersecurity Challenges Organizations face a significant escalation in cyberattacks as hackers continually evolve their tactics. This dynamic landscape makes it challenging for businesses to maintain effective defenses. A vCISO plays a pivotal role by providing specialized guidance in threat intelligence, risk management, and incident response. By working with a vCISO, companies can proactively identify vulnerabilities and implement comprehensive security frameworks tailored to their needs. This partnership empowers organizations to build stronger defenses against the rising tide of cyber threats. Compliance with various regulations remains a formidable hurdle for many businesses. Non-compliance can incur severe penalties and damage reputations, prompting the need for expert oversight. A vCISO helps organizations navigate complex regulatory landscapes and ensures ongoing assessments and strategic roadmaps to meet compliance needs. By implementing best practices aligned with the latest standards, businesses can mitigate risks and enhance their security posture. A Cost-Effective Solution for Security Leadership Hiring a full-time chief information security officer can be a significant financial burden, especially for small and mid-sized businesses (SMBs) with limited resources. A vCISO offers a cost-effective alternative, providing high-level security expertise without the expenses associated with a permanent hire. Organizations can customize vCISO services, enabling them to pay only for the cybersecurity guidance they require, thus allowing for more efficient allocation of resources. The digital transformation driven by adopting technologies like cloud computing, remote work, and the Internet of Things has further amplified the need for vCISOs. These advancements expand attack surfaces, making traditional security approaches insufficient. A vCISO aids organizations in implementing modern cybersecurity frameworks, ensuring robust data protection across various environments, including cloud services and remote workforces. Additionally, the ongoing shortage of cybersecurity professionals enhances the appeal of vCISOs. Many companies struggle to find and retain in-house talent, but a vCISO can provide immediate access to seasoned security experts with extensive industry knowledge. This accessibility allows businesses to improve their security strategy without the delays associated with lengthy hiring processes. The flexibility and scalability offered by vCISO services make them suitable for organizations of all sizes. Whether a startup outlines its initial cybersecurity strategy or an established firm seeks ongoing risk assessments, vCISOs can deliver tailored security solutions that effectively address specific business objectives.","source":"The Cybersecurity Review Europe","pubDate":"Tue, 28 Apr 2026 10:47:09 +0200","titre":"Read more","url":"https://www.thecybersecurityrevieweurope.com/news/key-drivers-behind-the-rising-demand-for-virtual-cisos--nwid-1282.html"},{"source":"EDPB News","id":2850552,"description":"Brussels, 27 April – Today marks the 10th anniversary of the GDPR’s adoption, the first comprehensive data protection framework spanning an entire continent, establishing clear rights for individuals and obligations for organisations across Europe. Following a year-long coordinated action on the right to erasure in 2025 , the CEF's focus this year will shift to compliance with the obligations of transparency and information under the GDPR . The GDPR ensures that individuals are informed when their data is being processed (under Art. 12, 13 and 14). This right to be informed is a core element of transparency and ensures that individuals have more control over their data. Next steps During 2026, 25 Data Protection Authorities (DPAs) across Europe will take part in this initiative. They will look closely to assess the compliance of controllers with their transparency obligations under the GDPR. Participating DPAs will soon contact controllers from different sectors across Europe, either through enforcement actions or fact-finding exercises. In the latter case, they might also decide to undertake additional follow-up actions if needed. During the second half of the year, participating DPAs will share and discuss their findings together, with a view to aggregate the results of their national actions and generate deeper insight into the topic. A consolidated report will then be drafted and submitted for adoption by the EDPB, allowing for targeted follow-ups on both national and EU levels. Background The CEF is a key action of the EDPB under its 2024-2027 Strategy , aimed at streamlining enforcement and cooperation among DPAs. In 2023, the EDPB published the report on its first coordinated action on the use of cloud-based services by the public sector . In 2024, the EDPB also published the report on the outcome of the second coordinated action on the designation and position of Data Protection Officers . In 2025, the EDPB issued the report on its third coordination action on the implementation of the right of access . The main objectives of this coordinated action are to ensure that the right to erasure is effectively exercised by individuals in Europe and understand how controllers comply with this right in practice. In addition, the EDPB identified good practices and the most important related challenges, with the aim of providing further guidance on this topic.  Throughout 2025, 32 DPAs across Europe took part in this initiative. More specifically, 9 DPAs have initiated new formal investigations or have continued ongoing ones, and 23 DPAs carried out a fact-finding exercise. A total of 764 controllers across Europe responded to the action, ranging from small and medium-sized enterprises (SMEs) to big companies active in many different industries and fields, as well as various types of public entities. The results of these national actions have been aggregated and analysed together allowing for targeted follow-up on both national and EU level.   Areas of improvement and main challenges The report lists the issues that were identified, along with a series of recommendations addressed to controllers, to help them implement the right to erasure. Seven recurring main challenges were identified by DPAs. The results confirmed some of the findings of the 2024 coordinated action on the right of access , for example when it comes to the lack of appropriate internal procedures to handle requests, or the lack of sufficient information provided to individuals. In addition, participating DPAs reported specific findings related to the reliance by some controllers on inefficient anonymisation techniques to handle erasure requests as an alternative to deletion. DPAs also noted inconsistent practices, and the difficulties faced by controllers regarding the determination of retention periods and the deletion of personal data in the context of back-ups. In addition, as the right to erasure is not an absolute right, some controllers face difficulties in assessing and applying the conditions for the exercise of this right, including in carrying out the different balancing tests between the right to erasure and other rights and freedoms.   Follow-up to help organisations comply  Extensive guidance, documents and templates exist at national level to help controllers comply with the right of erasure and help individuals exercise this right. In line with the Helsinki Statement’s objectives of making GDPR compliance easier and ensuring consistent interpretation and enforcement across Europe, the extensive guidance and templates already available at national level will be leveraged at EDPB level where appropriate.   Background and next steps The CEF is a key action of the EDPB under its 2024-2027 Strategy , aimed at streamlining enforcement and cooperation among DPAs.  In 2023, the EDPB published the report on its first coordinated action on the  use of cloud-based services by the public sector . This report is a response to President Trump’s Executive Order on Reducing Anticompetitive Regulatory Barriers . The Executive Order tasked the FTC with finding unnecessary regulations that exclude new market entrants, protect dominant incumbents, and predetermine economic winners and losers, as a first step to repealing them. “President Trump’s Executive Order recognizes that heavy-handed regulations can hurt competition, including by entrenching incumbent firms, raising costs for new entrants, and discouraging innovative new ways to serve customers,” said FTC Bureau of Competition Director Daniel Guarnera. “Competitive markets lower the cost of living, improve the quality of products and services, and drive innovation. Our engagement with citizens across the country and agencies across the federal government has underscored the importance of scrutinizing regulations to ensure that they don’t distort healthy, free-market competition.” Examples of anticompetitive regulations that the Chairman recommends for deletion or modification include: Biden-era Department of Transportation regulations that preference businesses owned by “socially and economically disadvantaged individuals” when awarding contracts for transportation projects, rather than allowing free competition on the merits. Department of Education regulations that permit colleges and universities to include the cost of textbooks and supplies as part of annual tuition, which thwarts students’ ability to save money by buying their textbooks through alternative channels. Proposed Biden-era Consumer Product Safety Commission regulations that would require table saws to use expensive finger-detection technology controlled by the sole patent holder. The report summarises the outcome of a series of coordinated national actions carried out in 2024 under the Coordinated Enforcement Framework (CEF). It lists the issues that were observed for some controllers, along with a series of recommendations to help them implement the right of access. A central element is controllers’ awareness of the EDPB Guidelines 01/2022 on data subjects rights – Right of access and whether these guidelines were followed in practice. EDPB Deputy Chair Zdravko Vukíc said: “The CEF is a valuable initiative that helps strengthen the cooperation among Data Protection Authorities (DPAs): by tackling selected topics in a coordinated fashion, they achieve greater efficiency and more consistency. How controllers implement the right of access lies at the heart of data protection and it is one of the most frequently exercised data subject rights.” Throughout 2024, 30 DPAs across Europe launched coordinated investigations into the compliance of controllers with the right of access, by opening formal investigations, assessing whether a formal investigation was warranted and/or carrying out fact-finding exercises.  A total of 1,185 controllers, consisting of small and medium-sized enterprises (SMEs) and big companies active in different industries and fields, as well as various types of public entities, responded to the action. Areas of improvement and main challenges The results suggest that more awareness raising about Guidelines 01/2022 is necessary , both at national and EU level, as the guidelines help controllers implement the right of access, explain how exercising this right can be made easier, and list the exceptions and limitations of the right to access. As a result of the 2024 CEF action, seven challenges were identified. One of them is the lack of documented internal procedures to handle access requests. In addition, inconsistent and excessive interpretations of the limits to the right of access were also observed, such as overly relying on certain exceptions to automatically refuse access requests. Another example is the barriers that individuals could encounter when exercising their right of access, such as  formal requirements or being requested to provide excessive identification documents. For each challenge identified, the report provides a list of non-binding recommendations to be taken into account by controllers and DPAs. Positive findings Despite the existing challenges, two thirds of participating DPAs evaluated the level of compliance of responding controllers with respect to the right of access from ‘average’ to ‘high’. One important factor identified as having an impact on the level of compliance was the volume of access requests received by controllers, as well as the size of the organisation. More specifically, large-sized controllers or controllers receiving more requests were more likely to reach a higher level of compliance than small organisations with less resources. Positive findings were observed across Europe. These include the implementation of best practices by controllers, such as user-friendly online forms enabling individuals to submit an access request easily as well as self-service systems to allow individuals to autonomously download their personal data in a few clicks and at any time.
